One question for you, do you think the state is going to focus on the emotional aspect and try to get a verdict based on that instead of evidence?

Yes.

West also recounted how the lead Investigator for the Sanford PD had played the “screaming” 911 call for Trayvon Martin’s father and asked him if the screaming was that of Trayvon, and the father had said it was not.

Interesting.

Can you offer any insight on whether you believe (or have heard) if Zimmerman will take the stand in his own defense?

If you think he will, do you think the accusations about him misleading the court about the money being donated to his defense will be raised by the prosecution to try and ruin his credibility?

I do not think he will take the stand.  I just don't see the upside for the defense. The State's got nothing, no sense seizing defeat from the jaws of victory.

In the unlikely event that he does take the stand, the issues around the donated money will certainly be fair game for the State.

Based on your overview, the dispatcher's testimony shed some light into Zimmerman's state of mind during the incident. If, as a trained professional, he didn't get the impression that Zimmerman was overly angry, who am I to argue?

I am guilty of using what many would probably consider too much foul language. The "F" word is one of my favorites. While I use it for many different occasions, you can (or should be able to) clearly tell my state of mind. If I am as angry as many would like us to believe Zimmerman was, the "F" word is most likely going to be preceded and/or followed by a few more four letter words. In fairness, my girlfriend of 8 years continues to sometimes have a difficult time noticing the difference.

Thanks again for the updates.

. . .

Thanks again for the updates.

Anybody who listens to the audio can clearly hear that the words are said with resignation, not anger.  The dispatcher saying as much just gives the jury "permission" to acknowledge this truth, in case they felt they needed it.

And, yeah, that's a big deal.  A HUGE home run by O'Mara.  HUGE.

The knock knock joke was just an incredible faux pas. It's what will be remembered by the public, especially since it's getting hammered in by the lib MSM.

Quite insensitive considering the gravity of the situation, and with TM's parents right in the room, and who knows how the jury took it. Those are the kind of things that sometimes nuance opinion far beyond the logic of things.

And besides that, it's an ancient joke, first heard it way back during OJ's first trial.

Well, see. Quite remarkable what sticks in folk's minds, even if subconscious. Can't hardly believe O'Mara vetted that.

And three hours. Too much right off the bat to grok by the jury I'd say, compared to the prosecutions few more precise points in a tidy 30 minutes. Hell, more than one commentator said that even Zim showed visible effort to stay awake during the third hour.

I'm of the opinion that there is no way he did that without it being calculated. No way that wasn't discussed and approved by the team before he delivered it.

So, if that is the case.

What does the joke accomplish (or could it have accomplished?)

Guess you'll have to remind me what the State's "points" were in that 30 minutes--other than dire vocal modulations and concerns about properly loaded handguns.

The audience for the knock knock joke was the jury and the jury alone. The jury apparently was non-plussed by the joke itself, but the defense lawyer's summary and contextualization of the joke ". . . after all you (the jury) have been through . . . " I think still has positive value for the defense. The media's ridicule of the joke has no value, as finally we're into a court trial with a sequestered jury -- and the media has no power in that circumstance.

I think the defense is doing a much better job, so far. They've kept things factual and boring, which kills the emotional pull the state is going for.

Based on what I heard, the state REALLY needed to prove what kind of mood Z was in that night. I don't think they did. In fact, I get the impression that he was rather calm and resigned, even when the "punks" and "always get away" part were stressed. Edited by BigK

I guess 30 minutes is enough if 99% of what you've got to hang your hat on is emotion rather than facts. ;)

Well, I can see how it may have offended some of them in another way. Basically, "you schmucks are on the jury because you're so out of the loop you didn't even know anything about the case".

I imagine we'll hear it mentioned again in the prosecution summation, too something like "the defense started this whole trial with a joke about how you the jury were selected, but I can assure you ladies and gentlemen, the fact that an unarmed young man with his whole life before him was murdered is far from a laughing matter..." or such.
