Those in the west TN area who frequent to MS might be interested in this. As you probably know MS has some very gray areas in their gun laws with OC being one of them. The MS constitution clearly states that only concealed carry can be regulated by the state. Some wacky case law or attorney general opinion has said that any gun even partially covered is considered concealed. The lawmakers used this to get around the constitution and make darn sure that anyone wanting to carry a firearm had to have a permit.

 

I have called and emailed the Highway Patrol in MS regarding whether OC is actually legal or illegal and all they say is "you have to carry completely concealed" and will not elaborate on it and provide a clarification of the law. I think some of that may be due to those gray areas.

 

This bill that has been proposed AND passed by the senate and house should be headed to the governors desk soon. It will clearly define what concealed means and from the way I understand it make OC not only clearly legal but you shouldn't have to have a permit for it.

This is great news.  MS is wierd with that whole partially concealed deal and really needing a permit.  The nice thing about down there is if you are 18 you can clearly keep a handgun loaded in your car without a permit. 

 

Then you can get a permit, or get the enhanced permit and be able to carry in schools.

Yes we need to get that issue fixed here in TN.  An enhanced MS permit is basically the same thing as a regular TN permit.  Pathetic that we can't carry in schools in TN.

This is great news for MS. It corrects the law to what the state constitution intended it to be, with CC regulated by laws and permits, and OC not illegal for anyone who can possess a firearm. The [incorrect] AG opinion last summer that we could ONLY CC spurred the process along, and now we have a clearly written law that describes what is concealed and what is not.
