Smith told the News Sentinel he chased the man outside. He said the
robber fired at least one shot at him from a .38 caliber revolver. Smith
said he returned fire, although he wasn’t sure how many shots he fired

He didn't shoot him while he was running away. He followed him out and the bad guy chose to escalate. I know I would have went outside to look for a plate on a get away car, or to see what direction the bad guy went, to help police track him down.

I don't think it was smart, from a legal standpoint, to chase the guy and get into a gunfight after the danger had ended. That being said, I don't think any charges should be filed unless the guy in the alley makes a formal complaint. :pleased:

Another success story. Personally, I think it should be legal to use deadly force to get your stuff back from someone who won't willingly give it back to you, but in this case the robber shot at him, the manager returned fire an won. It doesn't really matter which way a person is facing when they shoot at you. I hear, according to physics, that bullets travel the direction they are fired, not the direction the shooter is necessarily facing.

Give that man a medal. Feed the corpse of the deceased to pigs.

Don't get me wrong, one less criminal is always a good thing.  I can simply foresee our bleeding heart legal system making a mess of this.  I guess it all depends on where the entry and exit wounds are.

Look around on YouTube of MOST self defense shoots where the robber fired shots and the victim returned fire.. Especially those that take place in convenient stores. The criminals shoot as they're running away; backs turned and everything. Is that a valid shoot? Well, bullets aren't any less hazardous to your health when the attacker has his back to you. As far as I'm concerned, any reasonable person can articulate why an armed man with his back to you is still a threat. If he has already shown that he is armed I'm going to shoot him unless he is actively surrendering.

A cop friend of mine would agree with this point after getting shot this way.

Hard to say one way or another without having witnessed the event, lots of possibilities there, so it is hard for me to second guess the guy &/or his actions without more facts, that said, I personally would not shoot a fleeing hostile unless they were still engaging me while they were fleeing & I certainly wouldn't allow an active shooter to get behind cover/concealment, even if that included me having to shoot the shooter in his back to prevent it.

Shame that some sheeple will only look at "shot in his back" as guilty as charged & seek to convict the guy without even considering the possibility of it being a good shoot.
