Black powder gun not considered a gun legally?

I have a couple of friends who have told me that a blackpowder gun is not considered a gun, according to the law. They say that you can carry one without an HCP, etc. Can this possibly be true? Doesn't sound right...

I know that you can order one online and have it shipped directly to your home with no background check or paperwork. I do not know about carrying one.

In TN I don't think carrying a BP revolver pistol would fly without a permit. Just get the permit and you can carry what you want in the scope of handguns.

Under federal law, that is true, it's not a firearm. That's why you can get one shipped directly to your home.  And TN AG has even opined that even a felon may own one.

 

However, under TN TCA definitons, a black powder firearm still meets the definition of "firearm" and "handgun", and you can't carry a loaded one without an HCP.  Which you can't get as a felon.

 

On the other hand, many towns in TN have the old ordinance that all firearm carry is illegal, "except for an Army or Navy pistol, carried in the hand". Knoxville does, for example. Belle Meade did, for another example, until Kwik forced that issue.

 

But I don't believe I'd count on that. :)

Actually, In many municipalities you can still legally carry an â€œArmy or Navy pistol which shall be carried openly in the hand”. You don't need to test the police reaction to this as kwik has already done that for you.( I don't suggest trying it again) Belle Mead has also since revised that law so you would need to find another municipality with that version of the law still on the books.

"Sec. 19-104. - Carrying dangerous weapon.

Any person who shall carry in any manner whatever, with the intent to go armed, any razor, dirk, bowie knife or other knife of like form, shape or size, sword cane, icepick, slingshot, blackjack, brass knuckles, Spanish stiletto, or fountain pen pistol or gun, or like instrument containing a firing pin and capable of shooting tear gas or pistol cartridges, or any pistol or revolver of any kind whatever, except an Army or Navy pistol which shall be carried openly in the hand, or any other dangerous weapon, shall be guilty of a misdemeanor."

Look, you can carry an AR or AK pistol with your HCP, it's perfectly legal.

 

Just expect to be questioned, asked to see your permit. Maybe even held up while they call in to find out the ruling, etc. All of which is legal also.

Just because you can do something, doesn't mean you should.

 

I guess its good when people stand-up to being pushed around (even by the government or police) but that sure doesn't mean you won't look foolish doing it!
