Not sure how I feel about unlimited ability of LE to strip search?
 

HOUSE BILL 275

By Casada
AN ACT to amend Tennessee Code Annotated, Title 40,

Chapter 7, Part 1, relative to strip searches.

 

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

 

SECTION 1. Tennessee Code Annotated, Section 40-7-119, is amended by deleting subsection [b] in its entirety and by substituting instead the following: [b] Any person arrested for an offense may be strip searched in accordance with search or intake procedures.

SECTION 2. This act shall take effect upon becoming a law, the public welfare requiring

To be honest I'm quite surprised they didn't already have this ability.

 

 

Current law states:

 

....No person arrested for a traffic, regulatory or misdemeanor offense, except in cases involving weapons, a controlled substance or controlled substance analogue, shall be strip searched unless there is reasonable belief that the individual is concealing a weapon, a controlled substance, a controlled substance analogue or other contraband.
 

I see no reason to change that.

I do not like this at all!  This is the same technique some countries use to intimidate and humiliate their citizens.  

Throws out any pretense of "reasonable search".

What provisions are there for people wrongfully arrested and strip searched?  

" Ooops, we made a mistake, our bad....." is NOT ACCEPTABLE!

This changes nothing.

During the intake process all arrestees are already being stripped searched. The only exception are those that are making bond and will not leave the intake area. Those are placed in a secure area away from those who have already been searched.

Officers are not going to strip search people along the road or in a vehicle. They will do a pat down and nothing more.

LE is going to do a strip search in an area that is secure so if some attempts to toss evidence it is easily found as well as easy to determine who it belongs to.
