"An upstate New York police officer who was paralyzed after being shot on duty in 2006 died over the weekend, prompting calls for the gunman to be charged with murder."

 

"A funeral for Parete will be held Wednesday. Although an official cause of death is pending, if the shooting is found to be the direct cause of Parete's death, gunman Varner Harris Jr., who is serving a sentence of 30 years to life, could face a murder charge, according to Buffalo attorney Barry Covert."

I agree, and was wandering about this same situation... if someone was shot in a robbery and survived...but 10 years later had a complication and died from those injuries... would the person that shot them be charged with murder... wasn't sure if there was a statute of limitations on that or not

I don't know how  you could convince a jury of 12 people not smart enough to get out of jury duty that someone dying 6 years after an event is murder. Be a damn good case to watch and see what happens for the lawyers out there because stranger things have happened.

That would create a legal nightmare.   Yea, my brother's wife's cousin died from the injury she got 37 years ago when you bumped into her.  You are SO SUED now!!


You have 1 year in TN for traffic related deaths to be charged with manslaughter.

There is no statute of limitations for murder, so yea I am guessing that he probably will be charged with it.

I understand there is no statute of limitations  for murder or sex crimes... but how long before a person actually dies from an injury are you capable of being charged criminally...  I mean your actions didn't immediately cause death and could of been sued in a civil suit already, seems like a very complicated issue.

He has already been convicted, once. Even though she died 6-7 years later, and I'm not defending anyone at all, I

don't understand how or why the state would go back and do it again. When was the last time NY executed anyone?

1963. State law declared unconstitutional. What purpose would it serve? Maybe additional life without parole? Doubt

it.

I think it depends on if he's been charged and convicted on the robbery already too...  Otherwise double jeopardy may have already attached.
