Man arrested after posting FB photo with baby and BB gun

"Due to close proximity of the BB gun to the child, there is a substantial risk of physical harm and safety of the child," court documents stated.

That's absurd.  :shake:

I read pretty deep into the comments; apparently "close proximity" translates to "pointing at the child's head."

I agree with jcoosi.

I hear this all the time.  Then I remember all the reasons I do not have one.

The picture in the video shows him holding the gun on his knee, pointed away. It might have been a different picture.

Yup the photo that the news report showed/said was the cause of all hubbub was exactly as Shortround described, a guy sitting in a chair, baby in one hand/lap, with a BB gun in his other hand, the BB gun was pointed away from the baby & at the floor.

I saw absolutely nothing "dangerous" in that photo at all, in fact I hope the guy sues the PD for wrongful arrest.

Well that's obviously because of your ignorance of guns. If you would just listen to the media you would know that the mere presence of a gun increases your risk of being shot. I'm just glad the gun didn't have a collapsible stock or it would have shot the baby on full auto. ;)

While it is not the most  flattering photo and maybe not good publicity..and perhaps poor judgement on the guy holding the BB gun and baby..

Arreesting him for this goes way overboard...

My goodness...People need to find something else  to cry and make a fuss over...

And people still call this a free country. I think the picture is silly but good grief. This may very well be what we have to start dealing with.

And just recently I was holding a real gun that close to my baby, twice even! I must be the worst father ever, someone could have been seriously harmed!

That's almost as stupid as having your crazy ex wife as a FB friend:)

So show of hands, how many people with carry permits remove your sidearm before entering a room with a child? You should be ashamed, how can you defend yourself and your child from a home invasion, or zombie attack without your gun?

Here's the photo.  Judge for yourself if this is criminal behavior.  I honestly can't help but wonder if the outcome would have been different if the guy was white.

Based on this, that means I need to remove a couple of photos from my Facebook page before the SWAT team kicks in my door.

I would love to see the look on the Judges face when the evidence is shown in this case....your honor exhibit A is a photo of the defendant in a chair, holding both a child and a bb gun, you can clearly see both the child and the bb gun! The prosecution rests your honor!  HA! I think theres a lawyer out there somewhere that should take this one no retainer and just split the winnings from the civil suit with the "defendant" they could and should sue the police dept, the officers, complaintants, I remember something about another amendment withholding our right to freedom of speech and expression! So a hippy artist can take a picture of a rotting corpse with a child and thats ok but this isnt, I see the logic in that!

Reading the story suggests this is not so much about guns as about a vengeful ex-wife.

Or the one liberal anti 2a friend that many people have on their FB page and don't think anything of.

Damn straight. Nothing like splitting zero dollars several ways to make taking a case pro bono worth your while. ;)
