Private sales saturation?

Yep. Have you ever noticed that we have certain members who will sell 10-15 guns a year? Really makes me wonder who they get away with it. One of the moderators here has calmed down lately but I'm pretty sure he's sold more than anyone here.

 

And I guarantee the ATF has people who monitor the classifieds here.

 

Cute.  I'll say the same thing about whoever you're talking about that I say about anyone else.  If you think it's fishy, report them.  I'd do it for you if I thought you were up to something that was going to make the rest of the community look bad.  I expect our moderators to toe the line and hold themselves to a higher standard.

How is that even true? The ATF has no access to background check records and there is a law that all information associated with background checks at NICS be destroyed within the next business day unless the background check was held up for whatever reason. Sounds like your source was not truthful.


Let me recant one part of my post the suspicion based on bg checks is speculation. He was however 100% visited by an agent about how many guns he's bought and sold in a year. We both work together. It just so happens that when he was being investigated I was working at the aame place and they wanted to ask me a few questions about a former employer (gun shop) that had been set fire a year ago. Anyone who buys a firearm solely for the sake of re-selling it via private sale is begging for a visit from the BATFE.  You might get away with that once or twice in a period of time (determined at their discretion) but if you flip a bunch of them you're obviously selling without a FFL and will end up facing prison time.
 
Frankly I hope they start dropping that hammer on people sooner than later.  It would really staunch the flow of guns out of gunshops for the sake of resale and leave some inventory for people who really want to own certain items.



While I agree that I would like to see the jerks put out of "business", I am sure the media would run with it. All we need is a bunch of so called "proof" that private gun sales are out of control and need to be regulated or out lawed. But it may come to that anyway.

Been a rule for a good long while, couldn't tell ya when it started. Not just more than one handgun at a time, but also two or more in same week. Obviously, the FFL could only know if you got them all from him.

 

Since the buyer has no input into the additional report, there's no reason a buyr would necessarily ever know about it.

Huh, apparently it has been around since 1968 and the ATF has been requiring FFLs to report the transaction to them since 1975.  Never knew, but I guess I've never bought more than one handgun at a time.  Apparently they just passed one a couple of years ago that requires the same thing for multiple high capacity rifle purchases in Texas, Arizona and New Mexico.

Well, again, even if you bought two handguns at once, you still probably wouldn't know about it just because you did that.

 

Yeah, fairly big stink over the border states rifle reporting thing, but it died down pert quick too.

If you proxy these sales through an FFL would you still be subject to this rule?   I.E. buy them on gunbroker.com and then ship the gun to the winning bidder's FFL?

It's going to be very random at best.  They simply do not have the man power to spend a lot of time on this.

The law is the law regardless of how you sell it.  If you're buying for the sole sake of reselling, and you aren't an FFL holder, you are breaking the law.

I would really like to hear who the moderator who is or was selling lot of firearms on here. Send it to me in a PM if you want.

I cannot recall a single moderator selling any amount that would raise anybody's eyebrows.

I have sold less than four guns on here in as many years so I know it isn't me. And I have yet to sell a single firearm on here since becoming a moderator.

You need to slow your roll when it comes to selling Firearms out the back of your Rainbow Bus!  I don't think the ATF would have a problem finding your Rainbow bus! LOLOL :rofl:
