Can Barack Obama Ban Guns By Executive Order?

Recommended Posts

Might not be much prob banning all those firearms and ammo coming in from outside the US, just like Slick Willie and  Bush The Elder Dubya did with the Chinese stuff.

Obviously, further crashing the economy seems to be the least of his worries.

My aluminum foil hat and crystal ball says that a EO will be issued, and that immeidately it will be challenged and injuction sought and obtained.  Over the course of time, the legislation will catch up and either a EO will be withdrawn, knocked down through the courts and/or the EO will be confirmed.  In the meantime, the gun/ammo market will not return to normal until this all plays out.  Unfortunately this could be measured in months if not years, unless there is a fast track due to more public mass shootings.  The political machine knows they must pass any new restrictive legislation now before they get into an election year like 2014, otherwise it will not pass the legislation.

I wonder where Mr. Longley gets his information about Executive Orders? I can't find enough to substantiate what he says from

the original parchment. I think it has "evolved" like a liberal's belief in a "living, breathing document". I certainly disagree about

them becoming law because that is what Congress is supposed to do, not the President.

What something is and what something is supposed to be are two different animals. EO's are for administrative duties, not for

lawmaking. Letting the practice of EO's continue is a tragedy. Not for just this president, all presidents and every last one should

be nullified and replaced with law where it is supposed to come from.

Whether they should have been allowed to stand is problematic, though. For the record, G.W.Bush and Barack H. Obama have been the

most offensive users of EO's in the history of the country. Both have issued hundreds. Bunch of crap far as I'm concerned.

They are absolutely unconstitutional when they are used to create law.

As the prececent has been set, I can't wait to see what the next president will do and we haven't even started O's 2nd term yet.

To be entirely honest I'm not too worried about him trying to use an EO. It just won't go over well because at that point everyone will (hopefully) see that he is reaching way beyond his power. Not that many people would honestly notice or care, heck the some of the press would probably praise him for it.

I know. Scary, isn't it? All those precedents. When I saw the list, all it told me was who did or did not respect the rule of law. Bush was in the

thick of it, too, but not his dad. Kinda surprised me.

The article doesn't mention States of Emergency. The prez can do about any crazy thing by declaring a state of emergency.

Maybe congress would have the balls to decline a state of emergency declaration, but they routinely keep approving states of emergency every year that are decades-long. We have so many declared states of emergency, that some of them are classified and we can't even find out what they are about. Secret emergencies.

I'm not really a tinfoil hat fella, but just sayin...

What I don't think everyone thinks about is the fact that we are outnumbered at almost every turn.  We are outnumbered at the voting booth by people who think they are entitled to everything someone else works for.  We are outnumbered in the executive branch.  We are outnumbered in the Senate.  We will be outnumbered in the next election by losing the House.  We will be outnumbered on the Supreme Court soon if we are not already.  There really isn't much more to be done politically.

All the OHole has to do is have his lackeys at the EPA issue a ruling that the components used in bullets are environmental hazzards and tax the beejesus out of them.  Ban nothing just make the cost pf ownership so expensive as to drive most citizens out of the market.

No. We just refuse to engage in the process in a unified, meaningful way. The Executive branch doesn't count for anything since it is controlled by

the current occupier. The legislative branch is controlled by our meaningful votes. SCOTUS is an interpreter of constitutionality and can be despotic

at a turn, like you say, but that is part of our unified vote, also. We allow this to happen by malaise, cynicism and any other lack of interest you wish

to add. That may be about to change, though, through many. If we decided to get together and agree on the direction we want, we will do just that.

I've been on the wrong end of the process, believing people I wish I'd have been more skeptical about, but that's my fault. Not any more.

We are only outnumbered by our own lack of perception and direction. I know it will change, but I don't know when and I don't know how. Of course

it can be made much more complex than this, but we are being kept misdirected, but not outnumbered.

You're right, it is about numbers, but it is our fault for not putting our positions together. We forgot how to fight. They never have forgotten that.

Did our forefathers not right the Constitution and Bill of Rights to protect the people from the democratic vote? So that 60% of the people could not take away the rights of the 40%? So that some president could not decide to take away rights of citizens? They determined that EVERY citizen has certain rights that cannot be taken away by vote or decree.  If they take away our 2nd ammendment rights, what's next?

The 4th (You could reduce crime if LEO could just go through bad nieghborhoods and bust down some doors!)

The 5th (Everybody knows only the guilty plead the 5th)

The 1st (Watch yo mouth!)

IT STOPS HERE! The 2nd amendment stands and no one can change it. Unless we bury our heads in the sand and let them.
