Executive Orders????

Are these really legal. Yes I know they have been used going way back to the 1785's but isn't that just by passing the checks and balances our system of government is suppose to have?

Legislative Branch. Executive Branch, and Judicial Branch.

After watching that video in the other thread,(http://www.tngunowners.com/forums/topic/55747-adminstration-to-move-all-semi-autos-to-nfa-status-by-executive-order/) it leads me to believe in the last 90 days there have been 5798 orders?

At what point is it finally abuse of power? Do we no longer need Legislative? Should we just send them all home as it appears we have a king?

U.S. Presidents have issued executive orders since 1789, usually to help officers and agencies of the executive branch manage the operations within the federal government itself.

per wiki the courts have only overturn 2 and it appears our legislative has only changed 1.

That is 2 much power.

Executive Orders is a way for abuse with any president. Some are worth about the paper they are written on, but

the potential for abuse is too much for a reasonable Congress to allow. If they are in direct violation of Congressional

constitutional authority, they should always be challenged. I don't know the track record, but I imagine there has been

a lot of fringe and maybe overt abuse. I think they were only intended for managerial duties, not to enact or otherwise

circumvent Congress, but I suspect a little of both have occurred.

 

I know I wouldn't trust this president with Executive Orders, and I certainly hope Congress doesn't let their guard down,

if they have any, right now.

And the regulations have to be done with the force of law, done by Congressional authority, which, in this case, may

or may not be the case.

I believe with congress adjourned, or will be adjourned, he even has greater authority.  I remember President Bush nominating and confirming John Bolton for the Ambassador to the U.N. during the Christmas break, because the Senate would not confirm Bolton.  With the Senate adjourned, it gave President Bush certain legal powers.  I look for something similiar with Obama, his elevated powers  with the Senate adjourned, and guns.

Recess appointments.

 

Already been a big flap over this, BHO appointed a bunch of federal judges best i remember when the Senate was not officially in recess -- although in fairness, it has become the habit of the Senate to not officially do so even when they in reality do, they still have some silly deal where someone gavels it to order and then dismisses it each day, or some such.

 

Doesn't affect Presidental Executive Orders, Determinations, or Memoranda, though.

 

Looks like Dubya had the record for EO's, but BHO has already exceeded it.

But it isn't the number of EO's, but the content of one that can wreak havoc. I have never paid much attention to EO's

until recently, and I probably should have been looking at all of them. They're the kind of thing, like recess appointments,

that usually happen on a Friday, after the news has been done, only to simmer through the weekend and be forgotten.

That should work. If they would only use them for managerial duties, I wouldn't have a problem. I think we have

a bold fool in the White House who might try an EO for his gun ban when all else fails. He won't get the UN treaty

about gun bans and he won't get a bill through Congress. So, what's left? EO, and he will be overstepping his

authority. And the media will try everything including Tarot card readings to convince us that it's good.

As bad as I hate to say this, considering the political wind post CT, who would stand on the floor of the capital and call for a resending of a new EO regarding new gun law restrictions.  I know some far right wingers would, but we are in new territory by some of the comments that I am hearing in the "real" world, and not on a pro gun forum.  I am not throwing in the towel, and I will do my part writing to congressmen, and keeping the pot stirred, but I am amazed at some pro gun people who are now siding with Feinstein.

I would hope anyone in the House would. If it is an illegal act, it just is. I know if I were a member, I would be the

first one to stand up and complain. Then I would submit a bill to rescind his authority to do that. It is unconstitutional

to institute acts otherwise authorized to Congress.

I understand your point, however I could see the EO being sold as a temporary moratorium until permanant legislation is passed.  Illegal or not, guns are little bit taboo right now to the masses, and politicians will distant themselves from it until things cool.  We certainly do not need a copy cat, that would only make matters worse and solidify political agendas.  The nation is ripe for change.

But you have to admit, it doesn't matter how little or how much taboo something is, if there is an amendment for it and

you and I know it has more to do with society than the implement, that the implement should be defended at all costs.

The typical liberal ploy is to scapegoat something. This one has been going on since 1934(at least). Taboo is another

word for emotion.

 

We have never really fought about this, outside the NRA, etc, and some money and mail. If he EO's this, temporary

or permanent. he should be removed from office. Really, he and Good ole Joe both. An EO to this magnitude would be

like Martial Law.

I'm on yoursde, but listen to the moderate gun owners, not the ones on a board or hang out at the range or lgs, they want something done, even though it does nothing.

Executive Orders have ZERO force of law regardless of what any President says. If anyone can show me where in the Constitution this privilege is granted to a president I'll admit I'm wrong :) 

 

Even if he issues an order I won't comply because it's illegal and you can't pass a valid law that goes against the natural rights of a person.

Well, it's easy to see who is the top of that hit parade. Number two is a bit depressing, also. What's also depressing

is that most of the EO's in the list are for things that EO's were never intended .

Little issue here, when our founding fathers spoke of 3 branches of government, they meant the Executive (President), Senate (States), and House (People).

 

Judaical was wholly controlled by the other 3 branches, and other than SCOTUS can be removed at anytime for any reason by act of law. 

 

Legislative Branch. Executive Branch, and Judicial Branch.

There was an amendment regarding abolishing alcohol too, don't think there was an executive order, but when passion and the pulse of the nation is involved, anything can happen, even repealing a constitutional amendment. I'm on yoursde, but listen to the moderate gun owners, not the ones on a board or hang out at the range or lgs, they want something done, even though it does nothing.

 

2/3rd's of the House and Senate, plus 3/4th of the states.  All it takes is 13 states to say so, and the Amendment doesn't pass, I suspect 13 state legislatures who not agree to any changes in the 2nd amendment.
