Buying a gun as a gift?

I'm not going to do it as my wife has said MANY times that she doesn't want a gun for Christmas. But, I was at Academy last night buying a safe to make sure that no one does anything stupid with my firearms, and browsed by the gun counter for some reason. There was a guy there looking for a gun for his wife. He was asking the sales person about the background check and told him he was buying this for his wife. The sales person said, "Oh, if it's a gift it's ok." I thought that was a little wierd as the form asks if you are going to be the owner... or something like that, to make sure you aren't buying the gun for someone else. What are your thoughts on this? I would have refused to sell the man the pistol based on this, or would have at least had a manager sign off on it.

 

BTW: That browse almost cost me $550 on a Glock 26!

You are the owner. And then you give the gift at some point in the future. A straw purchase is when someone ASKS you to buy a gun on their behalf so they can avoid the bc. Seems the same but it is different.

Gifting a firearm is perfectly legal at least in TN and GA as long as both parties are residents of the sme state and neither party is a convicted felon or any of the other crap to prevent someone from ownership.

I just asked this question last week :)

 

Its only a straw purchase if you KNOW the person you are buying for can NOT legally possess a firearm (ie:  felon) ... If you have no knowledge -- perfectly legal.
