Yeah I don't think he could have as easily gotten the irons for wearing it at a public place like a park like he did at a private property.

Myszka first told police he was dropped off by a friend, according to an MPD report, only to later admit he had driven himself to the mall without a license.

 

I woulda charged him with driving without a license as well!

Our first amendment has pretty much always been "regulated".

 

I think many have a fundamental misunderstanding or lack of understanding of the right of free speech.

 

Some seem to think that you can say/write anything you want about anything or anybody you want at anytime you want and at anyplace you want.  You see this played out all the time when people use their company email to send controversial content or complain about internet forums who "stifle" their free speech by banning them from a forum, etc.

 

The simple truth is that the right of free speech does not give you the right to libel/slander anyone and it does not guarantee you a platform from which to speak or an audience to hear you.

 

How that translates for this guy is that he should have gone to one of the parks in Murfreesboro to display his t-shirt but when he went to the mall, he should have covered up or changed shits.

You have a good point and would like to expand on it a bit!

 

My understanding of free speech is, you can say any damn thing you like, but you're responsible and own what you say, and if you lied, hurt, libeled, created a panic or slandered an individual, that's what the courts and law enforcement are for.

 

Everyone knows you don't yell "fire" in a movie theatre and you don't bear false witness against a person.

 

And I totally agree, expression of free speech is limited to public places, the media and public venues. If I disagree with your views, your ideas are not welcome in my house or my property, private property. Homes, mall's, business's and places of employment are private property and they have the right to remove you or change your perceived conduct as they wish, if you want to stay there.

 

But I'm preaching to the choir. Just wanted to expand on it.

So it's automatically trespassing when someone's shirt says something you dont like? He was asked to remove the shirt. He didn't comply. If he left when he was asked to, there was no crime in what he did. I can't read anymore than what's posted in this thread (tapatalk), but what is posted here makes me think the charges are bs Bionic Post

That's the problem...he didn't leave private property when asked, and got arrested. Just what that moron needed...

You can be arrested in Tennessee for lying to the cops?

My arrest stats would have doubled if I could have done that in Illinois.

How much time do you get in jail for lying about how you got to the mall?

It said "falsifying a police report". I am not sure what the difference is, if any. I also think it is a bit of a reach. However they should have nailed him for driving without a license.

If he signed an affidavit giving false information, then yes he can be charged with filing a false report.

 

Also admitting to driving without a license is enough for a judicial commissioner to issue a warrant. I wrote one over the weekend on a shoplifter who admitted to the arresting officer that he drove to Walmart on a suspended license.

Why is he signing an affidavit for anything if he is just being arrested for trespass? Our requirements for filing a false report were that you lied about something pertinent to the case. How you got to the mall is a stretch, especially if you weren't being charged with any violations involving how you got to the mall.

When I read the article I assumed this was the guys way of showing his disapproval for guns and not meant to be disrespectful to those that died. I agree that the mall had a duty to kick him out. Did he refuse to leave?

Did you not read the article? I admit it doesn't give all the facts (big surprise there I know) but yes, the man was asked to cover his t-shirt and/or leave and he refused.  Security called the police and they arrested him for trespassing.

 

He also lied about how he got to the mall...the article doesn't say I but suspect how this became an issue was when MPD were identifying him they found out his license was suspended; since I'm sure he knew his license was suspended at some point in the process he lied about driving there (probably worried about driving without a license).  More details we don't have...I don't know at what point the "lie" about his transportation became an illegal act but one thing is pretty damn clear - this guy was an IDIOT.

 

He was an idiot not just for his disgusting message on his t-shirt but he was an idiot for wearing it at a busy shopping mall before Christmas while news of 20 small children being murdered was still fresh...he was an idiot for wearing such a shirt which was obviously going to draw attention to him (or at least is should have been obvious) when you ILLEGALLY drove to the mall.

Now, I'm no criminal mastermind but I my license were suspended and I was going to drive anyway; the last thing I would want to do would be to do something that was going to draw attention to myself and THEN, refuse to leave a business which was going to get the police involved.

 

If this guy was a driver for a bank robbery he'd probably hang magnetic signs on the doors announcing "GET-A-WAY VEHICLE"

This idiot wore the shirt with the intent to start some confrontation and get attention brought to himself, there's a segment of the population who gets their jollies by starting controversial confrontations. Defending your 1st amendment or 2nd amendment rights is one thing but this guy went out of his way to offend people, not just anti's but as I can read here pro-2nd amendment are offended by his tastless shirt also.

I own a shirt that says "Guns don't kill people, proper sight alignment, sight picture, and trigger control does".

It's not even in the same ballpark of distastefulness as this guy's shirt, yet I WOULD NOT wear that shirt in public right now...too many lunatic antis out there right now.

I’m sorry, but unless the guy absolutely refused to leave, the arrest was for political and emotional reasons and out of line. The mall has the authority to tell him to cover it or leave. But they don’t have the authority to tell him to cover it and then have him arrested if he refuses. It would be interesting to hear a more detailed description of what took place. Was he warned that if he didn’t leave he would be arrested?

I’m still laughing about arresting him for lying to the cops about how he got to the mall. rollfloor.gif  None of this will be prosecuted. You start arresting people for being stupid and that’s all you would be doing.

I don’t know, maybe this guy was on a mission and wanted to be arrested; if that’s the case he got want he wanted.

The story said he refused to leave...as I understand it refusing to leave private property once asked is trespassing; seems like a good charge on its face.  The mall absolutely had the right to ask him to cover his shirt or leave; most especially if they have a standing policy on such things which they seem to have...this moron's only chose at that point is to comply or not...he chose poorly.

 

Folks can laugh all they want about the "lying to police" issue but the news stories on several outlets say he was arrested for criminal trespass and "filing a false report". I understand that lying to police isn't illegal but filing a false report is; at least it is in the five states I've lived in as an adult. While we don't know the details of that "report" I see zero reason at this point to think the charge isn't legitimate. If they aren't legitimate then they'll likely be dropped.

 

The guys a moron but even morons deserve their day in court and he'll get his...but I bet he won't like the outcome.
