Man kicked out of Stones River Mall for 'extremely distasteful' T-shirt

A man ejected from the Stones River Mall in Murfreesboro for wearing what mall security deemed an “extremely distasteful” shirt was arrested Saturday on criminal trespassing and false report charges.

Stanley Bryce Myszka, 42, was escorted from the mall by security after he refused to remove or cover a shirt that read “Has your gun killed a kindergartner today?” He was arrested by Murfreesboro Police, who were called by security officers.

Wtf? I agree the shirt was distasteful, but are we really going to arrest folks for exercising the 1a now too? Kick him out, sure. Murfreesboro PD gonna get sued over this one. Bionic Post

First off, your first amendment rights don't give the freedom to say and do anything you want on private property. Secondly, he was arrested for tresspassing for not removing the shirt or leaving like he was asked. Again, private property. He was also arrested for for falsifying information on the police report.

No, we arrest folks for being asked to leave and their refusing...that's called trespassing I think.

While I understand his point, there are many ways to convey this without offending people. The shirt shows a total disregard for human life.

I think his only real point was his pointy head - I've been told a pointy head leaves less room for brain cells that the more traditional "round" version.  That theory seems to be supported where this guy is concerned.

Yep. Lots of liberals have that feature. You can flip them upside down and stick them in the ground, like a fence post.

He was asked to remove the shirt. He didn't comply. If he left when he was asked to, there was no crime in what he did. I can't read anymore than what's posted in this thread (tapatalk), but what is posted here makes me think the charges are bs Bionic Post

If you are asked to leave bythe property owner or their representative, ie, security officer, you can be arrested for trespassing.  After the arrest if you give false information you can be charged with that offense, too.   Don't think MPD is going to ever hear from an attorney over this.       Morale: leave when asked and don't lie.    The shirt is another ball game: Total disregard for the feelings of others just because your only concern is your point of view.

Thanks for the post smartass. As i said, i can only see what's posted and it doesn't say he refused to leave. If he did, it's clearly trespassing Bionic Post

A lot of people go to jail for exercising their 1st amendment rights because the people are victims. The bill of rights only gives you protection from the government not a buisness, person or private group. Here this guy was asked to cover the writing or leave. When he refused he was charged with trespassing. The mall and it's representatives will prosecute(through the assistance of the DA's office)

I don't get what you mean when you say "the people are victims"???

 

I see no one at fault here except for the one who went to jail...he could have complied and chose not to...it was the wrong decision.

What I mean by people are the victims is the government is not claiming an intrest but someone(the mall) chooses for this individual to not be there. By asking him to leave and he rufuses, he is subject to prosecution by the people(mall).

Example in a court case they say the people vs. .../ the state vs....../ Smith vs.Johnson Edited by Patton

Our first amendment has pretty much always been "regulated".

 

I think many have a fundamental misunderstanding or lack of understanding of the right of free speech.

 

Some seem to think that you can say/write anything you want about anything or anybody you want at anytime you want and at anyplace you want.  You see this played out all the time when people use their company email to send controversial content or complain about internet forums who "stifle" their free speech by banning them from a forum, etc.

 

The simple truth is that the right of free speech does not give you the right to libel/slander anyone and it does not guarantee you a platform from which to speak or an audience to hear you.

 

How that translates for this guy is that he should have gone to one of the parks in Murfreesboro to display his t-shirt but when he went to the mall, he should have covered up or changed shits.
