Shipping within state?

Have any of you guys shipped to another individual in the state? I have a guy that's wanting to buy a stripped 10/22 receiver that I have for sale but he lives in Memphis and is wanting me to ship it directly to him because he says his FFL charges him an extra $35. First I have heard this is legal but have you guys done this and would you reccomend to do this? He says he will send me pics of his DL and his HCP.

It's legal by both federal and TN law.

Can use USPS (no handguns) or UPS (can use overnight or ground for rifles, or rifle receivers).

Possible glitch is that by federal law you are [i]supposed[/i] to notify carrier if it's not going to a licensee and UPS terms of service require notification for all firearm shipments (Fedex will only send to or from licensee), and you'll occasionally get a postal or UPS clerk who doesn't know their own rules and will give you grief.

13 oz or under, USPS First Class package rate is under 4 clams with tracking.

I've run into folks that don't feel comfortable doing this although it is totally legal. It is how I prefer since I don't have to pay a ridiculous transfer fee. It drives me nuts to get soaked with a transfer fee and TICS fee if I don't have to.

I know its ok to ship a long gun but since it's just a receiver hypothetically it could be a pistol. Could that be an issue?

 

Shipping handgun intrastate is legal both by federal and TN state law too.

 

- No handguns may be shipped through USPS

 

- Fedex doesn't allow any gun shipments between unlicensed individuals unless you cheat and don't tell contents (which is against federal law and FedEx TOS)

 

- Which only leaves UPS who does allow non licensee intrastate shipping of firearms according to its TOS, but depending on clerk you may have probs anyway. Also, handguns must be send some form of overnight, not ground, (also according to UPS TOS, not by law). Must acknowledge contents of shipment (by both UPS TOS and federal law).

I'm reviving this thread.  I have had a similar request on a handgun.  So OS, based on what you state above....it may be legal but carriers' terms of service will not allow shipments of handguns?

 

UPS is your only option for a handgun if not going to a licensee. According to their TOS it is allowed, but you must declare it and it has to go overnight, and you'll need to do it at a hub. And hopefully you don't run into ignorant agent, which does happen.

 

The only federal law regarding it is that if not going to a licensee, must be declared as firearm to shipper. That and no handguns allowed sent by individuals period through USPS.

UPS accepts packages containing firearms, as defined by Title 18, Chapter 44, and Title 26, Chapter 53 of the United States Code, for transportation from and between licensed importers, licensed manufacturers, licensed dealers, and licensed collectors, as defined in Title 18, Chapter 44 of the United States Code, law enforcement agencies of the United States (or of any department or agency of the United States) and law enforcement agencies of any state or department agency (or political subdivision of any state), and from and between persons not otherwise prohibited from shipping firearms by federal, state or local law and when such shipment complies with all applicable federal, state and local laws applicable to the shipper, recipient and package.

    * Handguns, as defined by 18 U.S.C. § 921,will be accepted for transportation only via UPS Next Day Air® Early A.M.®, UPS Next Day Air®, or UPS Next Day Air Saver® services. (Note: UPS Express CriticalSM Service is not available for firearms).
    * UPS accepts firearm parts for shipment, provided the part is not a "firearm" as defined under federal law; the contents of the package cannot be assembled to form a firearm; and the package otherwise complies with federal, state, and local law. (Note: Receivers or frames of a firearm, firearm mufflers and silencers are considered "firearms" and are accepted for transportation only if shipped in accordance with UPS's requirements for shipping firearms.)
    * UPS does not accept automatic weapons, including machine guns, for shipment.
    * Firearms, including handguns, and firearm parts are not accepted for shipment internationally
    * Ammunition may be accepted for shipment internationally provided it is shipped in accordance with the UPS Guide for Shipping International Goods.
    * UPS ReturnsSM Services are not available for packages containing firearms.

Bumping an old thread with "new" info since I came across it for the same reason...

 

UPS will no longer ship individual to individual. I read it that way in their Terms of Service and also called to verify. Without asking anything, just mentioned I wanted to ship a firearm, I was told that it MUST go to a dealer or manufacturer. Essentially, a dealer must be on one of the two ends. That kills me buying a used gun because I know places like D&T will only accept shipments from other dealers so then you end up paying double transfer fees and killing the value in the used market.

 

From terms of service:

  • from a licensed importer, licensed manufacturer, licensed dealer, or licensed collector to an individual
  • from an individual to a licensed importer, licensed manufacturer, licensed dealer, or licensed collector

Yep, seems to be true, thanks for the post.

 

Their on site guide used to have "where not otherwise prohibited by federal, state or local law" as a separate clause, now that it tied to the two conditions you listed.

 

Full wording from:

So that only leaves USPS for intrastate shipping of long guns only. And as always, YMMV with that.

 

Also, this actually means at the least that there is no way you can ship handguns intrastate to another individual, or to yourself anywhere, even though both are allowed by federal law.
