Burglary suspect, held at gunpoint, calls 911

By Domingo Ramirez Jr. and Bill Miller

A Parker County woman called 911 early Tuesday, saying that her husband was outside, holding a burglar at gunpoint.

"Hurry up now, because my husband's fixing to shoot him," the woman said after giving directions to their house near Springtown.

The man with the gun pointed at him had the same idea.

He, too, called 911. "He's going to shoot me," he told the operator.

The dual 911 calls were made about 12:30 a.m. from the house in the 100 block of Lelon Lane, a spokeswoman for the Parker County Sheriff's Department said Wednesday.

When deputies and Springtown police arrived, they found a man, identified only as a 38-year-old resident of the house, holding a gun on a man in a pickup.

The resident told officers that he and his wife had awakened earlier to find an intruder wearing dark clothing and a hooded jacket standing in their bedroom.

When the resident asked what the intruder was doing, he answered, "Just unlucky, I guess," the officers reported.

The intruder ran from the house and got into his pickup, followed by the armed resident, who ordered the man to drop his keys, which he did.

The first 911 call came from the wife, Parker County sheriff's Deputy Danie Huffman said Wednesday.

The next one came from the man in the pickup.

The operator asked his name, and he responded, "Philip Tanner."

"Why have they threatened to shoot you?" the operator asked.

"Because I'm on his property," he said.

"Were you trying to break into his house?"

"No."

"What were you doing?"

"I was ... I was walking."

"Do you live out there?"

"No."

"OK, I'm going to stay on the phone with you until we get a deputy there. He's not that far off, OK?"
"Are you sure?"

"Yes. I'm sure. Just don't move. Tell the gentleman you're on the phone with 911 and I know what's going on and we have a deputy coming. OK?"

"He's going to shoot me."

"No, he's not going to shoot you. Just don't move. Just don't move."

She stayed on the line and kept the man talking.

And in a few minutes, officers arrived just as she had said.

They arrested the man in the pickup, identified not as Philip Tanner, but as Christopher Lance Moore, 41, of Bedford.

Moore remained in the Parker County Jail in Weatherford Wednesday night with bail set at $35,000.

He faces a charge of burglary of a habitation.

The armed resident of the house was not arrested.

Good story. I can't say that the homeowner following the guy out of the house was a smart move...pretty dumb actually when you consider all the possible consequences, but I'm glad they caught the guy.

Thank God for stupid criminals!

I don't think I would let him out of the bedroom. Breathing that is. In all honesty, I'd probably be so freaked out by a stranger standing in my bedroom that I'd pee my pants and go all screaming monkey on him and try to push his eyes out through his ear canals with my thumbs. (We're talking 28 weeks later style here) Then if I had the presence of mind to get my gun I would. And no I don't mean that in a rambo way. I mean it in a so friggin scared that I might not remember what I was doing way. Edited by gnmwilliams

This. However, I'd be so mad from peeing the bed, I'd shoot the guy just for making me that scared.

I don't know how or why things like this happen. If I woke up and some dumb a** is standing in my bedroom....he would become immediately deceased! The only one to call 911 would be me. That's what I find wrong with this story!

Different state, different laws...

Texas doesn't play around with self defense laws... It's very dangerous to be a criminal there, TN should take a lesson and toughen up some of our property crime laws to allow the use of deadly force... We'd see a sharp decline in crime if we did.
I'm not talking about "legal"...I'm talking about stupidity...different state laws don't turn a stupid act an intelligent act.

If this thug had been armed, left the house but then turned and shot the homeowner when the homeowner followed him outside there would be any number of people here saying how stupid it was to follow the burglar out of the house...

and those people would be right. Edited by RobertNashville

Should you call 911 after you kill an intruder?i mean its no longer an emergency. They have a number for non emergency calls.

Our local PD doesn't have one. I actually called their front desk one day to report a malfunctioning traffic light and they told me to hang up and dial 911.

Of course, a dead intruder is an emergency if you want to get the meat wagon there before his liquidy parts soak into the subfloor.

Personally I won't be the one to declare someone dead even if half his brains are two feet outside his head. Not my job and I'm not qualified. Someone gets shot on my property I'm dialing 911, with all the talk about some of the outrageous things folks are worried about getting brought up in a civil suit or by an over zealous DA it seems not dialing for medical attention would be at the top of the list of things to consider.

How would it look to a jury if a slick attorney started turning it against you?

"So Mr. Nicky, after shooting my client you chose NOT to call emergency services, why is that?"

"He was dead."

"So your a doctor Mr. Nicky?"

"No"

"Yet you felt compelled to make a judgment call reserved for trained medical professionals?"

"It was pretty obvious he was dead."

"Are you aware that many people have suffered similar serious traumatic wounds only to make a full recovery?"

"Well he looked pretty damn dead to me."

"Is it not possible that given proper medical attention my client might still be alive today?"

"Hell if I know."

"Hell if you know indeed. No further questions."

----------------------------------

Yeah, not me. I'll just go ahead and make the call.

If I shoot someone in my house, I'm calling "crime stoppers". I want the $1,000.00" reward for "stopping a crime"!
