I don't know why the clerk opened the door instead of calling the cops on the punks.

Could be more to the story. It said the owner was supportive of the clerks right to defend himself, maybe they mutually agreed it was in everyone's best interest if the clerk went to work elsewhere.

I am wondering where the rest of the video is. Looks like the TV station did a lot of editing. If the clerk shot the guy right after that one punch, I would not be surprised if the clerk gets charged with aggravated assault (or worse if the guy dies). I don't see anything cls to imminent threat of death or gret bodily injury (under TN law). Not sure what the standard is in Texas.

Assault a convenience store clerk at 0330 in the AM and you might get shot a little bit. Those places are known to get robbed. Opening the door was a stoopid move though and will probably be what gets him charged. If it was as simple as someone coming into his business at 0330 and assaulting him, he would have every right to put this sorry waste of human trash in the ground.

Unless there is a lot going on that isn't apparent; the store clerk was an idiot to open the door to someone he had already been arguing with...I can't imagine how he could possibly think doing that was a good idea.

Shooting someone who, at that moment, had only thrown a punch if that is [u][i]really[/i][/u] all that happened before the shooting began (i.e. no additional movements to keep punching or violent threats, etc that isn't being offered to the public on the tape) also seems like an inappropriate level of force in response. I'm guessing, however, that there was more than just that one punch before the clerk fired; at least I'd like to think so.

Just a few weeks ago, one of the trainers at Tactical Response noted (highly paraphrasing here) that it seems as if it's just not possible anymore to just have a "fight" without someone pulling a gun...seems he was right. Edited by RobertNashville

I like the pretty poster saying he was an "innocent young father", maybe he should have been at home with his kids at 0330 rather than out with his boys at the stopnrob. Lots of unanswered questions here.. who is the random tall black guy that was locked in with the store clerk prior to the shooting? Was he actually holstered or pocket carrying because unlocking the door with gun in hand doesn't seem like a way to a peaceful resolution.[/font][/color]
