TN Lemon Law Help

Looking into the lemon law details about used car sales for one that just keeps crapping out. Also, I'm starting to suspect the dealer showed me bogus carfax (Pulled up carfax on a different vehicle and then showed that to me). I'm getting close to taking it back and demanding my money back, some legal precedent would be helpful.

State website is all I can say. Used cars may not be covered, but did you get a warranty from the dealer?

How did the dealer represent it to you? I wouldn't rely on a CarFax or any other of those critters. Driving

it and having someone, say a mechanic inspect it is always good advice for the less than mechanical

crowd.

Curious, what is the make/model/year?

2000 Ford Taurus. It's the 3.0L 6cyl flexfuel. The dealer told it was an 01. I'm not sure if he was trying to rip me off with that or if he was honestly that stupid that he didn't know. He represented it as having no issues other then an AC leak, had just replaced the brake pads and the battery but that was all. I can say he was honest about the brake pads. They replaced the pads without realizing the problem was warped rotors and air in the brake line. I've put 4000 miles on this thing and already I've replaced a leaking radiator reservoir, the aforementioned front rotors, and practically then entire rear brakes after the adjusters recently came loose and the whole freaking thing pretty much came apart.

I'm not sure if a 12 year old used car is going to qualify as a lemon. Most of the things you replaced are routine maintenance. Can you prove the dealership was deceitful?

No lemon law on used cars, but tn. Has a 30 day return law I believe ,you can also take them to small clames court, for misrepresenting the car talk to the dealer head sales manager first and see if he will give you the full amount back on another car on the lot. Oh yes and don't get any Taurus

It’s a 12 year old car and you’ve driven it 4K miles. Sell it and move on to something else.

You would need some serious misrepresentation to have a case. And even then he wouldn’t worry about you unless you had a lawyer; lawyers cost money.

It's been a long time since I've sealed in selling cars but I believe the old law was the vehicle said it has to be returned in 30 days or 1000 miles. Was there any kind of contract or warranty implied?

Sorry but I really don't feel as if you have a case here. I think you would spend as much as the car is worth to try and sue him. If you had proof that he represented the car as having a clean carfax or if you can prove he represented it as a 01 but it's a 00 you would have a case.

Yeah I figured. I was just bein hopeful. I'm starting to wish somebody would run a redlight into this POS. (the car not the dealer)

Was the reservoir cracked? Sometimes the problem on Fords is that the reservoir is too full. I have a 2004 Taurus

as an away car for my work. Stays at the motel where I stay. It is reliable. If you have those things fixed that you

mentioned, just don't drive the Hell out of it and you probably have a decent car. Transmissions and the engines

are usually okay. I can help you with the A/C leak if you want to take a ride up to Clarksville sometime. At least

pinpoint the leak for you and tell you what to do.

What you've described so far is not a lemon, but a lack of caveat emptor. Hey, it happens. :D

I've had my share of fixing cars because my back yard is full of Ebay purchases. Mostly salvage titles, except for

the Bimmers.

If you have any questions, PM me. I'll try to help you through some of the stuff. No big deal.

The year on the door sticker doesn't tell the car's "year".

The month and year do. Anything manufactured after August or September will usually be the next year's model. So if the date says "08/15/00" that would actually be a 2001 model.

The rest of the problems are just maintenance and wear and tear. Best bet for buying a used car that old is buying one from an individual that can provide you with at least an idea of the maintenance preformed.

Just curouis... how many miles are on it when you bought it?

Has the car been wrecked/repaired? We're you notified that the car was wrecked/repaired by the dealer that sold it to you? There is a law in TN for that. It is incumbent upon a car dealer to proactively inform you if the vehicle has ever been wrecked. I wound up with one of these and discovered it 3 months after purchasing it. I printed off the state code and took it to the dealer. I told him that he could either give me my money back or we'd take it to court. This particular law is a consumer protection law and the dealer understood that he'd lose. Just a thought.

My 2011 F150 was built in late September 2011. Still a 2011 model.

Miles, about 150,000. I knew it wouldn't be perfect when I bought it but it seems like it literally comes out of the shop only to make a new noise the next day. I'm not worried about the ac leak as it doesn't affect an essential function. It is possible it was involved in a wreck that he didn't tell me about. There's a decent amount of body damage but again, nonessential so wasn't a concern, the Ford logo on the steering wheel is cracked and bent and I've been suspecting that that was a result of airbag deployment.
