I got denied today!?!

So I went into a local gun store today to buy a rifle case. While there I saw a nice used Mossberg 500 for $275. I said I'll take it. Will filled out all the paperwork and it came back denied. I have a HGC permit here in TN and I just bought an AR lower receiver last month at that same store. I filled out the appeal paperwork and now have to wait for a response.

I haven't done anything wrong before anyone gets any ideas. The guy said 5 other people were denied there today 1 of them being a local cop.

Anyone ever had this happen to them?

It happens...it happens to me about every third time I buy but then eventually approved.

Once it happened when on a Friday I bought a Glock 30...was looking at a shotgun but was undecided. The sale for the Glock went through fine; went back the next day to buy the shotgun and it was denied (that was the same month I was initially issued my HCP!).

It makes me wonder what the hell is up with the whole process.

There's the problem. That Handgun Got Confiscated document stuck out like sore thumb. :)

Seriously, folks post this all the time here, so it obviously happens a lot, and sounds like a real glitch in the system if a bunch from the same gun store were denied in same day.

I always ask though, did you use your SSN on the 4473?

Good question OS, I always have put my SS# just for that reason. I figured considering "they" already have my name and address on the form and "they" issues me the # in the first place it wouldn't be to hard for them to put two and two together to make four anyway. Plus I try to do business with LGS who seem like good people, if they should prove to be not so good people I'm still willing to bet they don't want anything to do with the guy who just bought a new gun and a crate of ammo.

Maybe the FFL is on the hot seat, and has been flagged. I would think it would be very unusual for 5 mistakes or 5 too close to call approvals on the same business day, either on purpose flag in the system or a technical issue. unless the FFL was trying to smooth over the waters to make the denied buyer feel better.

Maybe your wife has a friend that works for TBI. My wife would do this in a heartbeat!

I READ a response from TBI to a gun store about a denial. Basically it said the TBI was no longer denying or approving the purchase. That it was up to the store owner to decide to sell it or not ???? < this is mind boggling to me.

Yep, called "conditional proceed".

"What is a Conditional Proceed?

If during the background check TICS locates a record with outstanding disqualifying charges or charges that are undeterminable as disqualifying, TICS will deny the transaction. Upon an appeal of the denial, TICS will attempt to find disposition information on the charges in order to make a determination of eligibility to purchase a firearm. If TICS cannot obtain the information within the mandatory 15 day limit, the transaction will be marked as a Conditional Proceed. This means that the firearm dealer may lawfully, at his/her discretion, complete the transfer, although it in no way means that the dealer must complete the transfer. Should the dealer choose not to complete the transfer, your only appeal is to the FBI's NICS Appeals Services Unit. You may contact them at (877) 324-6427."

Ok just an update. If you ever get denied just fill out the appeal paperwork and wait. It is useless to call anyone. I got a call from the shop the other day and my denial was overturned so now I have a new shotgun. Hope this doesn't happen next gun purchase.

Congrats on your new gun.

It didn’t happen by accident. It will probably happen again unless you find out what happened.
Saying to “just fill out the paperwork and wait” because it’s useless to call anyone isn’t good advice. If I had done that I would still be getting denied.

Of course I doubt many here that know they are eligible are going to sit and wait when they get denied. [img]http://i4.photobucket.com/albums/y111/TourGlide/Web%20Stuff/biggrin.gif[/img]

If the TBI is denying people for no reason, it won’t get fixed unless people complain. They were clueless in my case, I’m not sure how the people I talked with found their way to work in the morning, but they did give me enough info to contact an agency that did know what was going on (BATF).

I guess that department does not need a phone line. I guess we can cut some government spending there as we have heard similar reports of being unable to get information over the phone on what happened or status.
