Can anyone help here? Going over some of my Dad's old things in the attic and found an old gun in a box with a lot of papers. The gun is a H&R Handygun. After checking I found the paper work from ATF from 68 where he registered it before the deadline. Do I need to have this transferred to me or is it OK to possess with the original papers? I've dealt with class 3 weapons before and know it seems like they make the rules as they go along but has anyone here dealt with this before. I want to stay completely legal. The gun was bought by my grandad in the late 30s or early 40s and would like to get any paper work straight because it is a family heirloom. I've heard it can be transferred for a $5 dollar fee, but you can hear anything. Does anyone have any info? Thanks-----Mike

I think you need to use a form 5 when you inherit an NFA weapon.

Jones, you're absolutely correct. Mike, you need to fill out a BATF Form 5 http://www.atf.treas.gov/forms/pdfs/f53205.pdf

You are entitled to receive this gun tax-free since you are a lawful heir. Hopefully, the registration paperwork has all the information about the gun (manufacturer, barrel and overall length, etc.) to use on the form 5. It's a fairly straightforward process... you say you're familiar with NFA purchases... basically a form 5 is a form 4 with a couple of extra boxes to check. The deal is the same as far as prints, photos, and CLEO signoff, just no check for 5 bucks. If you have any questions, just give me a shout, I'll help anyway I can.
