Brad Staats, the GOP candidate for the 5th Congressional District for Tennessee, posted the photo of a silver and black Colt 1911 semi-automatic pistol last Friday on his Brad Staats for Congress Facebook page, captioning it with the following:

Many people in Tennessee keep asking me about my opinion on Second Amendment rights. Apparently Tennesseans are part of that crazy crowd that Obama says "cling to their religion and guns." Well, then I must be part of that crazy crowd. H

ere is something that I usually have with me. Welcome to Tennessee Mr. Obama, where we appreciate our 2nd Amendment rights and the Constitution that was wisely given to us by our founding fathers.

Now personally, I think your "restriction" should be over with the moment you get your HCP here in TN. I mean, let's be honest here, if you have a valid HCP, you shouldn't have to have a TICS background check every time you buy a gun. But that's a STATE issue and not one with the presidential race.

It's partially federal. BATF decides which states can do that, based on state's background checking depth and frequency and followup on jerking permits after a disqualifying incident. Not all states have the option. TN does, so here it is indeed a state issue. Some, if not most, states simply can't do it at all even if they want to unless they change their issuing procedures and submit to BATF for approval.

Here of course the TICS is a revenue stream, and this loss of income was even discussed with proposals to offset it in last legislative term when a bill arose to do just what you want.
