I am planning on starting a sbr build. I do not have any parts for it, but my plan was to build a pistol first and then play with it while i am waiting on the tax stamp. When I buy my lower receiver, do I need to fill the paper work out different than when I would buy one to use with a regular length rifle? Also, would I be able to get a tax stamp for a suppressor at the same time as the sbr stamp?

The paperwork to actually buy the lower is no different between a receiver, rifle or pistol lower.

When you fill out the Form 1 to make a SBR you will list the information for the lower you purchased. Then in the meantime, not after the paperwork comes back, have the lower engraved with your name as well as your city, state.

You can put the forms for your SBR and suppressor in the same envelope.

Dolomite pretty much covered it. Usually on the 4473 when you transfer it there are 3 options, handgun, long gun, & other firearm (frame, receiver, etc.). It should be transferred under that 3rd option which gives you the ability do build either pistol or rifle out of it. Certain states like california only allow the rifles, so they have to be transferred as a rifle part.

So it would absolutely have to be transferred through an FFL as a handgun to build it as a pistol? What if the lower was purchased in a private sale?

No. If it is transferred as the third option, frame/receiver - you can build either. In Tennessee, regardless of where the receiver was transferred through - it should have been transferred this way. I say "should" because I have heard of some FFL's that will ask what you plan to build, and transfer it as either a handgun or rifle. Don't read too much into this detail as I was just showing it to you as an FYI sort of thing.

Okay, I've always been curious on that and how it works. I've been pondering doing something similar with an AK build, by sending off the paperwork but building it as a pistol in the interim. I was never clear on whether or not that was legal, or if I had to do some legal voodoo to make it okay. So really, it doesn't matter how it originally came from the FFL, if I have the spontaneous desire to make it a pistol that is good to go?

As long as it transferred as a receiver only or as a pistol then it can be a pistol.

If it is transferred as a rifle or ever assembled into a rifle it can never be a pistol.

The rule of thumb is "once a rifle always a rifle".

For a SBR AK I would recommend finding a Draco pistol then adding a stock after you have the SBR paperwork in hand.

That would be the cheaper option and much easier, but I haven't seen them in 5.45. If they did I'd have already bought it and submitted the paperwork.

I guess you couldn't go with a Krink build in a pistol configuration then go to sbr after the paperwork comes in? Edited by gjohnsoniv

That's what I figured I'd do. Not too many good options on price though. It looks like it would be twice what an SBR'd Draco would run me. I figured I make it a pistol first just because of the wait times now. At least I'd be able to go shoot while I'm waiting.

I've yet to see a Krink parts kit that wasn't what a Draco was running though, so yeah you are correct.

It's a shame no one is producing an American parts kit, or if someone does, I am unaware of it.
