Stolen gun from auction sold to a FFL

EDIT: may not have came from McMinn auction after all.

So a gun that supposedly came from the McMinn Sheriffs Department gun auction (supposedly but very likely)got sold to another FFL a month later, and was found to have been stolen. What's the chance that the McMinn sheriffs department and their auctions FFL missed this gun being reported? Gun was a off brand < $200 revolver. I

I'd like to hear what McMinn county does about this. They should have run the numbers, I'm sure the owner would like to have his gun back. How about keeping us up to date on this one?

Well, given that's apparently what happened I'd say the chances are about 100% :)

More seriously, I can think if at least a couple of different ways this could have happened....not the least of which is a SNAFU with whatever database they would have checked that should have indicated the gun was stolen (assuming it had been reported stolen at the time they would have been checking).

Does anyone have the auction list of firearms? I'm looking for a Arminius 357mag that would have been sold there.

It could happen. I doubt any LE Agency would get rid of it without running it through NCIC, but they could have run the number wrong.

I mean hey… a guy orders a TV and gets a SIG AR…. Anything can happen. biggrin.gif

It very well could be that the gun was clean until after the auction. It it isn't reported by the owner then there is no "hit" then it would have come back clean through the ckecks.

I would hope so. I've still got the receipt, so I could probably get my money back from them.

What happens is that when the police confiscate the firearm and run a check the gun is reported as not stolen.

The police department don't just auction them off or sell them in the same week, or event he same month or even year.

They have to keep it until they close the case on what ever it was that they took the gun.

I've seen it happen personally, My Grandfather was going to buy a Remington 870 from an FFL (here in Knox County)

the Remington was bought from from a local Police department. When went to buy the 870 it came back STOLEN.

I still don't know what ever happened to the FFL, as he though maybe the police department MIGHT issue him a refund?

And if you must know, the FFL Dealer was "Personal Defense Options" off Watt Road in Knoxville.

They are GREAT people and hate that it happened. I hope the police department made it good with them.

Odd, there was a 38spl Arminius that sold for $145. The exact amount the guy said he paid for the 357 Arminius.
