Wow, 3 pages of junk, when I should have stopped at post #3.

There is a provision that prevents carry in "any publicly owned building, without the express permission of the authorities in charge of the premises or property" (Section 16-23-420(a))

I have just read through all (or at least I think :D) of SC's laws on their site concearning handgun carry, permits and offenses, but I still have some questions that I'm hoping you all can help me confirm.

  1. In all of my reading, SC code only mentioned concealable weapons. Does this mean that SC is a "concealed carry" only state? I couldn't find anywhere that specified CC or OC.
  2. In the above quoted portion of (Section 16-23-420(a)), define publicly owned building for me. I'm reading that to mean any "state, county, or city" owned building?
  3. (Section 23-31-225)...Does this mean that I need to ask permission from a rental property owner (ie: a resort or motel) before I carry onto their property? There's still the whole signage posting requirements in (Section 23-31-235) much like we have here in TN, but the way I read (Section 23-31-225) I need permission beforehand. What do you all think?
  4. And here's one for all you law junkies. Let's say a man goes to mytle beach, doesn't know all of the laws required to know, and ends up getting arrested and slapped with a felony (SC likes the word felony in their codes). What exactly happens to this said man in his home state of TN due to this felony charge in SC?

All of these answers are just my opinion of course.

1. According to http://opencarry.org/ there is no OC in SC period!

2. I take it the same way you do.

3. I would say no. The code says "residence". I have always taken that to mean a privately owned home. If you were going with a friend to someone's house you didn't know...you would need to secure permission from them before entering their house armed.

4. I honestly don't know. But I would say it would not be good and that you would loose your HCP at least. You would not be able to buy any more guns. AFAIK all the forms for HCP and/or buying a fiream simply ask in you have been convicted of a felony...it doesn't matter where.
