Ok so quick question. The wife got pulled over tonight (taillight) she busted on my truck this am no sympathy at at for her. The question is when he asked for her dl he asked for mine to. I gave it to him but where does he get off asking for my dl?

Where does he "get off" asking for your DL?? It's his job perhaps?

it is not normal to ask for ID on the passengers, but IIRC officers can always ask for ID of adults and you are expected to have it. If it is not on you, not sure that they can do much, could be a vagrancy charge or something minor and stupid (????) but they can ask. Wonder why he did...

I was not driving I was a passenger seatbelt everything done right. I have been pulled over once or twice from coast to coast and never seen this done before.

I think you are dealing with a routine question...cops like to know who they are dealing with and I think I can understand why...how many times have we heard about a copy pulling over a a very non-suspicious person; even a husband and wife, only to wind up shot dead?

As a matter of law, if you aren't driving I don't believe you have any obligation to hand over your DL or any other ID for that matter but whether you do or don't I would unless you have some good reason not to or unless you are aching to make a point.

I have had that happen in the nashville area and after he looked at the ID I asked if it was normal to ID the passenger. He said they do it to see if a name in the car matches up with the tag and registration of the car. He said most cars are not rported for 36 hours after being stolen and they have recovered a number of stolen cars before they were even reported this way. He may be blowing smoke but I had nothing to hide or a point to prove so I took him for his word. He did not run either of our IDS and let us go with a warning about our speeding. All in all a decent experence.

They can ask, and you can refuse. There is no law requiring someone to have an ID on them if they are not operating a motor vehicle.

We are not required in this country yet to carry ID at all times. However back to the original question If you are driving you had better have it, at least in this state. Sure they can look it up, but like our HCP, you better have it on your person.

From what I understand that is Standard Ops in Oak Ridge to check everyone in the car. I to a point disagree with it, a the passenger was not driving. kind of like seeing someone walking down the sidewake and checking the immigration status. Unless person A is breaking a law, should not check for another that you are not certain about. On the flip side of the coin, they do sometimes find people that have warrants for arrest by checking the non driver.

However, it probably boils down to everyone in the vehicle is considered lawfully detained because of the traffic stop.

My bigger question is, if they disarm you and then run the serial of your gun, that seems to be a round about way on the 4th amendment. Note that hasn't happened to me, but I have in the past been checked just being a passenger.
