HR347 empowers the Secret Service to declare any place they choose a "no protest zone" making it a felony to violate. Here is Judge Andrew Napolitono's take:

Carry a sign, chant a slogan in sight of a politician, get a nice long vacation in the pen. The Secret Service is claiming this is no big deal.

This Act may be cited as the `Federal Restricted Buildings and Grounds Improvement Act of 2011'.

SEC. 2. RESTRICTED BUILDING OR GROUNDS.

Section 1752 of title 18, United States Code, is amended to read as follows:

-`Sec. 1752. Restricted building or grounds

`(a) Whoever--

`(1) knowingly enters or remains in any restricted building or grounds without lawful authority to do so;

`(2) knowingly, and with intent to impede or disrupt the orderly conduct of Government business or official functions, engages in disorderly or disruptive conduct in, or within such proximity to, any restricted building or grounds when, or so that, such conduct, in fact, impedes or disrupts the orderly conduct of Government business or official functions;

`(3) knowingly, and with the intent to impede or disrupt the orderly conduct of Government business or official functions, obstructs or impedes ingress or egress to or from any restricted building or grounds; or

`(4) knowingly engages in any act of physical violence against any person or property in any restricted building or grounds;

or attempts or conspires to do so, shall be punished as provided in subsection (

`( The punishment for a violation of subsection (a) is--

`(1) a fine under this title or imprisonment for not more than 10 years, or both, if--

`(A) the person, during and in relation to the offense, uses or carries a deadly or dangerous weapon or firearm; or

`( the offense results in significant bodily injury as defined by section 2118(e)(3); and

`(2) a fine under this title or imprisonment for not more than one year, or both, in any other case.

`© In this section--

`(1) the term `restricted buildings or grounds' means any posted, cordoned off, or otherwise restricted area--

`(A) of the White House or its grounds, or the Vice President's official residence or its grounds;

`(of a building or grounds where the President or other person protected by the Secret Service is or will be temporarily visiting; or

`© of a building or grounds so restricted in conjunction with an event designated as a special event of national significance; and

`(2) the term `other person protected by the Secret Service' means any person whom the United States Secret Service is authorized to protect under section 3056 of this title or by Presidential memorandum, when such person has not declined such protection.'.

Sounds to me like it can apply to almost anyone anywhere they want it to

they are missing out on some $$$. It should instead require people to buy a liscense to exercise their constitutional right, same way they do other rights, for profits.

I'd guess the people who penned this one have enough money; what they want now is uncompromising surrender.

I wonder if this is a direct result of those "Occupy" idiots peeing/pooping all over the place and all the trouble it caused in several places?

Regardless of their intent...it's a bad law!

It's just another example of legislation that is so broad it can/may apply depending on how bad they have it out for you. This is the stuff that folks buy off on because they believe everything they're told and want to be safe. What a crock.

The more i see the more I think maybe the Hunger Games isn't as far fetched a tale as it first seemed.

This has been coming since 9/11. It's an extension of broader powers by those who wish to keep us in fear, instead of risking

the public discourse and becoming representatives of the people. Tyranny comes in all shapes and sizes,too, David. Yeh, a few

decades ago. The trouble is, they are boxing themselves in and it will eventually get ugly.

Our political class needs a lesson taught to them. Potomac Fever is getting really bad.

i did the audiobook. Good point, Caster. That was a good piece of science fiction. Good because it was somewhat believable.

Here's the Tennessee law which is comparable to the federal law. The TN law has been in effect for years:

39-17-305. Disorderly conduct.

(a) A person commits an offense who, in a public place and with intent to cause public annoyance or alarm:

(1) Engages in fighting or in violent or threatening behavior;

(2) Refuses to obey an official order to disperse issued to maintain public safety in dangerous proximity to a fire, hazard or other emergency; or

(3) Creates a hazardous or physically offensive condition by any act that serves no legitimate purpose.

A person also violates this section who makes unreasonable noise that prevents others from carrying on lawful activities.

© A violation of this section is a Class C misdemeanor.

HR 347 is nothing more than a disorderly conduct statute that the Secret Service can enforce. (Some states don't give Secret Service agents "peace officer" status, so they are not allowed to make arrests for state law violations.)

HR347 is a misdemeanor punishable by no more than one year in prison, UNLESS the person carries a weapon and/or commits serious bodily harm. Then it becomes a felony.

A legally carried handgun and a anti-Obama sign could equal a felony. This law was not needed or intended to prevent violent acts. Plenty of laws against that already. This law is only to allow the Gov to squash protests.

Even a misdemeanor for exercising free speech is an outrageous breach of the constitution.

Regardless of their intent...it's a bad law!

Think about it....Obama supports the occupy people, sits back and watches it get worse and worse...oh wait a minute that gives me an idea to pass a new law so that doesn't happen again....hmmm wonder how that happened. The government are artists when it comes to creating problems that never existed then "fixing" them, aka passing a bunch of new laws giving them more power and us less freedom....the biggest of which was 9/11, but I'll stop at this point as I could go on all day.

18 USC 1752 was passed under the Nixon administration in 1971, and has only slightly changed since then. The latest revision (HR347) ads the word "knowingly" to the statute and added areas protected by USSS; otherwise its similar to the same law that has been on the books for both Republican and Democratic Presidents for the last 40 years. It passed both the House and Senate without a problem because its a long standing law which doesn't have a history of abuse. There's plenty the Obama administration has done which is questionable. This isn't one of them.
