Yeah, but the nut job is still alive. MOre tax dollars flushed down the toilet on this wacko. It would have been justifiable to just put the guy down without a word. Save us all a lot of money and possibly future lives saved when this guy walks on some stupid technicality.

Bottom line, the nutcase was stopped, carrier did not have to shoot anyone and face the scrutiny of legal issues, doesnt have to worry about mental distress from shooting another human, and is dubbed a hero. Had he of pulled the trigger, the liberal media would have made him out to be an evil bad guy just like in the Zimmerman case. I hope I ever have to draw and show weapon that it ends the altercation without having to fire. That is the ultimate goal.

Even as screwed up as this country is, no jury here TN would convict you for intervening in a stabbing like that.

My issue is, if I take my pistol out of its holster, I've already made the decision. Otherwise, it'd never leave the holster.

But if YOU are not in fear of YOUR life it is not a justified shooting , right ? Unless the knife comes your way ? Deep ......

What our instructor told us in our carry class was if your level of fear for yourself OR SOMEONE ELSE has risen to the point you believe THEIR LIFE OR YOURS is in danger you are justified.

Still, it's good that he was able to defuse the situation without having to resort to bloodshed on his own part.

Agree from what I remember from my HCP class. . . ."your life or someone elses". also, to my understanding, no real requirement to order the bad guy to "drop the knife", but probably a good CYA for the gun owner.

Someone (Fallguy :) )correct me if I'm wrong on this:

The way the TCA is written, deadly force can be used to protect yourself or another if the requirements for deadly force are met. The funny thing is, what this guy did is ilegal in TN. We don't get to use the threat of deadly force to stop a life/limb threatening perp, only to use the force itself. LEOs can do that, but non-LEO citizens can't. That said, no DA in his right mind would try for a charge on that techincality given the facts of this case. At least, that's my non-attorney understanding of the TCA.

This was not a hypothetical use of force situation. The perp had already stabbed a couple of folks. The perp is lucky he's alive, because if he had been shot it would have been justified.IMO

Totally justified in every sense of the word.

I think he did right by ordering the perp to "drop" the knife. Then I think he could have used that as his defense in court if he would have shot if the perp didn't drop the knife. I commend the man for controlling his emotions with a firearm.

The handgun instructor I had, said a "good thing to do", if you are ever in a "draw your gun and/or shooting situation", is to yell as loud as you can (loud enough for any witnesses to hear) 'STOP, FOR YOUR SAFETY, STOP!!" Then fire if you have to. You have now warned that person. Not every situation will this even be possible. You have just given that person the opportunity to break off the threat or take what's given him. The decision is on him!
