Snake!!!!

As I said earlier, this is a non-profit organization. They are NOT an official state entity and have zero authority to ever tell me what I will do or not do. Who cares what they put on their site they can say the sky is black, that doesn't make it so. They site no code at all on that site either. And the code that exists does not pertain to these situations at all.

I know the law and I don't need for them to tell me the law, they have their own ulterior motives.. Never worry about killing a snake in your yard if you feel it's a threat to you. Period.

If you want to worry about the snake huggers then do, but I sure as hell won't.

OK, so maybe it's not illegal, we are just getting that it is from this site? Wow, I guess I'd better do some research to see what I can find out since I was told by a TWRA officer it was illegal.

Oh I'm not going to worry about killing a snake, shoot my cats would eat whats left and want more.;)

I just got off the phone with TWRA and the State of TN. and beleive it or not according to them, TCA 39-17-101 states "it is against the law to handle a snake" which they interpet as being against the law to kill a snake, this is their only reference.

So if I am to interpet the law litterly, if I don't "handle" the snake then it's not against the law. OK fine by me I ain't touching one dead or alive.;)

I don't think it is ok to break the law but I also believe that we were given the brains to determine if something is dangerous or not and a copperhead slithering through my back yard is dangerous so I would have to take appropriate actions.

Its the same as going over the speed limit, if you go 5 over you are still breaking the law and surely you can't tell me that you don't exceed the speed limit, maybe not wreckless speeds but over is over and so does that mean you choose what laws to break?

We each have to decide what is best for us and do so accordingly, I think of myself as a law abiding citizen, I don't steal, I don't kill, I don't do things that criminals do, I pay my bills etc, but I am guilty of speeding (not wreckless) and I would be guilty of killing a poisenous snake if it was in my yard.

BTW, I have never killed a snake in TN.

Regardless of what laws say, as I mentioned in another topic, I will do what is right.

In my case, that means that if it ain't poisonous, we go out separate ways. I prefer snakes around the place to mice eating my Cheerios in the cupboard or rats in the outbuildings. If it is poisonous, it's a dead sucker.

I'm not meaning to argue ;) but I just think we always have to use common sense when it comes to danger in our lives, whether it is destroying a venomous snake or shooting to stop a threat, none of it is pleasurable but sometimes it is necessary, it is not about breaking laws and thinking that is ok, it is about surviving and most of us have that instinct in us strongly.

Ahem. So you are assuming we break the law if we kill a snake. I can kill a snake and not break the law so no I am not picking and choosing to which laws I abide. And lets say a TWRA official says it is against the law, which in itself is grey, they do not necessarily know the law. Do you realize how many law enforcement officers have thought they knew the law and were wrong? Do you know how many government officials who you call about a law are wrong. It happens a lot. DHS and DCS case workers will often say they know the law on a subject and they don't.

No, but I did once stay at a Holiday Inn Express.

I am pretty sure we have established it is illegal to kill a snake in TN without the proper permit.

There are a whole series of commercials in which a person acts as an expert in some field. When someone makes a comment about their skills they announce they are not whatever profession the person thought they were, but that they did stay at a Holiday Inn Express last night.

It's also illegal to shoot/kill a person unless there is a reasonable threat to your life. A poisonous snake in my back yard where my young daughter might be is a reasonable threat to me, so the snake dies and I don't think I have to worry about the legality of killing the snake.

Yes, but just as you can't shoot a person for the fun of it, to me the law says you can't shoot a snake or any wildlife for that matter for the fun of it.

While some people have a fear of snakes, I don't think simply seeing one would constitute a legal "reasonable fear" for killing one. Just as some people may have a fear of a certain gender/race of people, simply seeing someone that fits that gender/race does not make it reasonable to kill them, even if they have had a previous bad experience with that gender/race.

Honestly, I don't think you have to worry about killing a snake at all unless you do it in a school yard in front of kids with the local TV station taping it and with PETA demonstrating in the background.

I'm sure there is some reason for this ridiculous law, probably having something to do with Federal funding and the protection of "wildlife." I imagine it was intended to protect Red-Tailed Hawks and not Black Snakes.

I think almost all of us can agree on that.

You kill one in your yard (or out in the middle of no where for that matter), bag it up, throw it away....who is going to call a TWRA officer? If by chance someone does, how is going to prove that you weren't in fear when you killed it?

Just remember that snakes actually play an important rule in nature. They are the terminators of rodents and other creatures that you don't want in your house. Not many make it to adulthood and then successfully breeding is another story. That is why these different kinds of laws are in place.

That is an interesting story about the copperhead hitting the bucket. How did you know that it came out to specifically strike at you if you didn't notice it till it hit your bucket?

Annnnd snakes are venomous, not poisonous. Venom is inject, poison is ingested. ;)
