Legalities of carrying at work?

I hope I worded that title correctly....Anyway. In my profession I occasionally have to work late hours, weekends, and travel to remote locations (with-in the state of TN) and sometimes outside the state. With the law that basically states that any business owner wanting to "opt out" of allowing firearms/weapons on their property they must post the appropriate signage .

I have recently received my HCP for obvious reasons. While my travel and late work is limited I have always want to be able to protect myself if needed. My employer has but a single line in the employee manual that "bans" firearms/weapons at work.

  • Bringing firearms or weapons onto the company or client premises

Direct quote is listed as a "major violation of company rules and grounds for termination." With that being said, there is no posted signage on the building of our offices or the majority of our clients. If I keep everything properly concealed weather is be on my person, bag, car, etc. should I worry about getting caught or losing my job? I think the terminology is pretty grey and depending on the situation would be waived.

Also, can someone clarify this for me? http://state.tn.us/sos/acts/107/pub/pc0033.pdf

It the company is not posted then it is ok for a non employee to carry there. If you carry there or at a clients place and get caught, you will most likely get fired.

Simple enough. This just randomly popped in my head. I'll end up asking the owner here soon. He's a HCP holder, carries daily, and has a firearm in his office at all times.

As stated above, posting is for the non employees. Employees have to abide by the company's rules and your company's rules state no firearms. So if you violate those rules, you're subject to their disciplinary process which will probably be you losing your job.

That's good. If he says it's okay to carry while on work premises, then you're golden. I would definitely get him to sign that in writing just in case though but remember if he's the owner and makes the rules, he's the one who can change them as well.

I 100% agree with this. Never held a job where I had to worry about my employer back-dooring me for anything, but even if he said oh yeah, sure, something could come up one day where the situation backfires. Let's say his son comes in drunk one night picks up his gun and points it at you? Just sayin, get it in writing if he allows it

Being legal & not getting fired for something are 2 totally different things. Its perfectly legal for you to cuss your boss out, but you'd most likely be fired.

Same thing goes for carrying at work if its not legally posted but its against the rules. You wont be breaking any laws, but you might get fired.......

I REALLY hope they guns in parking lots bill passes. Everyone call your senator! :)

Great way to put it. I hope the bill passes as well. I work in a somewhat shady part of town and it gets sketchy in the evenings. With the summer and it being light out longer I shouldnt have to worry.

Just to add, they could legally fire you for even asking if you could carry a gun at work... TN is an at will employment state. Not saying your boss would.. but as others have said, it's not illegal, but that doesn't mean it won't get you fired.

I would not talk to my boss about this. If you want to carry, just carry discreetly and don't tell anyone at work about it. Telling the boss can give him ammo to fire you.
