Technical Way around Restaurant Carry?

Also people charged with the protection of persons or property can carry in places where alcohol is served for onsite consumption.

Now if you read this law by the letter, A bouncer in a bar can carry a gun. No training required, no permit, just buy a gun, get hired as a bouncer, and you can carry in that bar.

Most HCP peopole that I know, have at least some training, and take carrying seriously. How trained do you think most bouncers are. I have seen a couple out at the range that couldn't clear a malfunction. In some cities, the bars hire off duty LEOs to bounce. But if the LEO goes in when not working for that bar, he can't carry. How do these laws make sense to anyone?

Very good points Shadow!

You know, I don't think that is something that was ever brought up among the legislators during discussion about the restaurant carry bill. That there are already firearms around alcohol, the ones that owners and their employees have. Of course if it had been, probably just would have been successful in getting that provision removed. :D

Finally I can go out to a decent restaurant without Mars or Phantom as a chaperon!!

Seriosuly, I wonder how citing that a BP revolver is not a firearm would hold up in court.

I'm guessing not as good as "honest your honor it was my nephew's gun".

I kinda doubt that for most restaurants. Joey's Pizza Barn might have it, but not yuppie restaurants I suspect that company policy is that generally none of the employees are armed. Better to have dead employees and patrons than face a lawsuit because one of your guys shoots someone. :nervous:

Actually it was more individually owned bars/taverns I was thinking of. Even though there are no such things as "bars/taverns" in TN. :nervous:

I think the question is why? Carry or don't everything else is nonsense.

The likelihood of being exposed with a handgun runs about the same risk as disassembling and trying to argue the point. If the LEO is that bent on making a case on a weapons charge he has you either way. drawing it out in court isn't going to benefit you much.

Bingo.

Carry concealed (concealed means concealed). If you need to use it you will be covered by the Safe Harbor provision in the law.

Note, this is not an incitement to break the law.

For those of you that may have or do eat at Big Ed's pizza in Oak Ridge, they serve beer and the owner carries everyday that he is there. He sometimes even conceals his 1911 under a shirt.

Little thread drift. When I send handguns through mail I take whole top end off and send it direct to buyer/gunsmith and send frame seperate.

If ups/fedx gun grabers steal it at least they didn't get whole gun.

So you have twice the cost and chances of getting back just weapon parts?

Befriend the owner, owner appoints the group as the restaurants security detail.....you can all carry...right?

Wait, do they have the sign that says carrying is against the law? I have been in a few places that only serve beer and the sign is NO WHERE to be seen.

I thought there was a distinction between "beer joints" and bars.

There is no legal difference between a bar/beer joint/tavern/restaurant in TN. That was one of the problems with the restaurant carry bill....and is the main issue that is going to be addressed in the summer study committee.

Any public place that serves alcohol for onsite consumption does not need a sign to say it is illegal. It is statutorily illegal (39-17-1305) and a sign is not required by the statute

I have heard the same thing. Sooooo we have to wait until a committee addresses the differences and then wait for a bill to be introduced for carry again. Course the SIMPLE fix is to allow carry unless posted by the business but NOOOOO ain't nothing simple anymore.
