Is there case law that supports this contention?

And if it comes to a court case, no smart-ass lawyer can claim you

ambushed his client and shot him without warning. With the barking dogs

he had plenty of warning and knew he was trespassing.

Genius!!!!!!!!!!!!!!!!

My dogs usually begin howling before the object of their interest is trespassing.

unfortunately, our neighbors dogs generally just howl mostly out of boredom (and are routinely bored) . There are probably 4-5 pockets of dogs, and one pack will set off several others. It is too easy to dismiss them to consider them for security purposes. If they were trained better, exercised and played with more, perhaps. For this neighborhood, It is all-out, or nothing, and no real threat correlation to the dog's responses.

Wish we could get more clarification on what the original question actually was.....

Yeah, me too. We have the 2 chihuahua alarm system, and as long as we keep em fed, thats all our service cost, and they are very good at hearing anything, er.. uh.., is that now some kind of unfair advantage against the criminals? Edited by gl19gobang
