As written, would exempt handgun carry permit holders from criminal background check requirement when purchasing a firearm. Passed Sen Fnc Ways and Means 10-0 at the end of the previous session. Might give an interesting read on this chambers attitudes and intents going forward...

And McNally has proposed an amendment to add $6 to both the HCP application fee and the renewal fee to cover the potential loss of revenues from the resulting loss of TICS check fees.

Well, Southerland moved it back to the calendar without any discussion or debate. Not a full calendar today (only 7 items), nor anything else that seemed to be a particularly contentious issue...oh well.

I could live with that. If that six bucks is the "closing on a minor point" that makes it happen, that's fine.

They have something like this in Texas. Probably other states too.

BATF allows any state which has NICS check as part of permit issuance to do it, but only a few have. There may be a time limit as to renewal durations with re-checking NICS involved too, not sure of exact details.

As I mentioned, they foresee significant loss of revenue with the $10 per sale tax.

If just 1/3 of TN permit holders buy a gun from FFL per year, that's a cool mil per year gone.

Maybe, and yeah, the estimate is on them. Surprised they put it that low though. Especially since there's no database on it unless they cross reference gun sales with HCP at the time of approval. Come to think of it, though, maybe TBI isn't bound by the federal rule to destroy all records daily; or such a statistical keeping doesn't fall under guidelines of what TBI is legally able to keep?

Michigan you have to purchase a gun purchasing permit(background check) wait 2 days then buy handgun. This is waived with a ccp.

The math for the dollar figure is laid out quite plainly in the fiscal note: apparently, TBI estimates 10% of HCP holders will purchase a firearm in a given year. There are 307,000 HCP holders at present: .1 x 307,000 x $10 = $307,000. The wording of the sentence, however, is a train wreck...which gives rise to another possibility, I guess. If TBI told the preparers they figured 10% of firearms purshases were made by HCP holders (what the wording seems to imply), then the preparers of the note used the wrong number: shoulda been .1 x $10 x [#firearms purchases/yr], not #HCP holders.

Who knows? More of govt's finest at work and play...

Personally, I wouldn't give a crap about undergoing a background check if they would just do away with the $10 'sin tax' for HCP holders. I have filled out those stupid forms often enough that I can now literally complete them in less than two minutes. Fill in name, address and so on, check 'yes' on first question, 'no' on all others, skip the one that is for legal immigrants (#12 iirc), fill in place of birth, state of residence and sign on the back. No problem - I mean, the state already knows I have an HCP so it isn't like they don't already know I own guns. I just don't think we should be paying $10 every time we want to excercise the Constitutional right to keep and bear arms - especially after paying $115 startup + $50 every four years for the 'privilege' of exercising our right to be equipped for self defense.

Which why support for McNally's amendment is critical. It effectively removes the Fiscal Note and makes the impact revenue neutral.

An amendment is now attached to this bill to increase the cost of HCP application and renewal by $6/each to help offset the loss in revenue from not running background checks on every purchase.
