prohibited locations ?

Reading over the discussions about the parking lot bills and various other threads about posted locations got me to thinking.

I understand the concept of a private business having rights but do we have private business anymore ?

If we do then we can have black only and white only lunch counters, we can have a restaraunt that is only one big smoking section, hell we could have child porn playing on the tv in a bar. Otherwise these are not private business and our 2nd ammendment rights should not be trampled on.

By that analogy, no one has a "private" house either. The government can control whether you can operate a business out of your home, whether or not you can cook meth out of your home, etc. So, if that means your home isn't "private" either, then you couldn't stop someone from practicing their religion or speaking their mind (1st Amendment) in your home.

I understand the concept of the rights of the people. If you have to buy it; it’s not a right.

Not only does Tennessee not recognize your right to bear arms, but they are so arrogant they think they are going to drive a “privilege†down the throats of business.

I have an HCP in this state, but I do not support any legislation that picks out 5% of the population and tries to tell business owners that these are the “chosen few†because they spent a few hours at a range smokin’ & Jokin’, and sent the state some money. Citizens have the right to have a gun in their car or they don’t.

Carrying a loaded gun in your car in this state is a crime. Until that changes I don’t see how any this legislation could make it through the courts.

It just seems highly selective what "rights" people are and are not allowed to exercise in a "private" business.

If it truly was that way then I would be fine with it but why is it ok for a private business to suspend some but not all of my rights ?

If I were running a business I could suspend any portion of the bill of rights I choose. Though really only the 1st and 2nd would really be applicable, I can prohibit free speech and your supposed right to carry a firearm. If you have an issue with these I can ask you to leave, and you do have the right to go elsewhere or be arrested for trespassing.

You do not have freedom of speech, right to assembly, protection against search and seizure, right to an attorney or protection from self-incrimination, right to trial, or right to carry a gun. So what rights are you talking about?

What rights do you have on someone else's property?

The US Constitution is a document protecting your rights from government infringement. It is not a document protecting your rights form private property owners. I challenge you to find the part that defines differently.

If it really was the way you're saying, then would you let me on your property if I chant Muslim prayers with a bullhorn?

Think about that for a moment before you answer the first question....

But can you really ? Can you say only people with Red hair can come in ? Can you say everyone must remove all their clothing at the door ? Heck could you say that everyone MUST carry a gun to come in ? Could you ask people to leave because they were speaking a foreign language ?

Yes. There are some “special groups†that are protected by special laws, but you didn’t hit on any of them and that has nothing to do with rights anyway.

List specific rights you think you have that are being violated.

I have the right to refuse service to anyone. I can do all of those things listed. By the way, none of those are rights. Your right to carry a firearm comes from the second amendment. The bill of rights does not apply to private property, only to the doings of the government. I believe you are confusing rights with privileges.

So if it isn't rights then what does dictate what the owner of a private business can or can't do ?

As a business owner can you tell the OSHA inspector that he isn't allowed inside ?

The Supreme Court has said that unless a business allows the inspection; OSHA needs a warrant.

So yes, you can tell the OSHA inspector he can’t come in.

Its State and Federal laws that tell a business what they can and can’t do.

Handgun carry is a privilege sold to a select few by the state; for the rest of the citizens it’s a crime. I’m not aware of any language in the law that says a business owner can’t ban guns on his property.

No, not really, I don't have to have a beer license , liquor license, have my kitchen inspected regularly by the health department, have handicap parking or handicap restroom, marked fire exit's. I could go on but I think maybe you are starting to see where I am coming from. If it is your business and by god you dictate what happens in there then you wouldn't have to comply with all those things to stay in business.

Sure we would have to comply; “all those things†are required to have a business open to the public.

Maybe I’m slow but I’m not “starting to see where you are coming from†or how you got from “Rights†to this. You claim a 2nd amendment right to carry a gun into a business, but that’s just non-sense.

I’m not saying you shouldn’t have that right, or that you might not be able to force that on a business if a citizen had a right to carry, but you are in Tennessee and they don’t recognize “Carry Rights†in this state; only “Carry Privilegesâ€.

But what right does the government have to tell me I have to have a rail on my stairs at work ?

I think it comes from the Federal Americans with Disabilities Act, or maybe OSHA. My first clue would be from who it was that told you to put it up.
