When I have heard back from my attorney I will let you all know. I have not yet heard back.

1. Declining Prosecution

One of the most significant aspects of the American legal system is the wide discretion that American prosecutors have in criminal matters. For example, a federal prosecutor may decline to prosecute an offense because he or she finds it not significant enough to merit prosecution in federal court. For instance, the quantity of drugs involved or the loss to a victim may be relatively small. The investigating agents may then present their evidence to a state prosecutor (assuming the offense is one that may be prosecuted in state court), where, again, the state prosecutor has discretion to prosecute the offense or to decline prosecution. Similarly, the federal prosecutor may decline prosecution of a minor offense if he or she considers that there is an acceptable alternative to prosecution, such as an agreement by the defendant to compensate the victim of the offense.

Defendants charged with minor, non-violent crimes may be eligible for pre-trial diversion into a program that usually includes making restitution to the victim. If the defendant completes the program successfully, he or she will not be prosecuted and may avoid a criminal record.

Another instance in which a prosecutor may decline to bring charges or ask the grand jury to return an indictment is where, although there is enough evidence to obtain a persons arrest, (that is, probable cause), the prosecutor knows that enough additional evidence to convict the person at trial will be unavailable. In such circumstances, the prosecutor is not obligated to seek an arrest warrant. In fact, if a prosecutor did bring charges or obtain a grand jury indictment and have a defendant arrested under those circumstances, this could be viewed as an abuse of the prosecutor’s discretion.

I'm continually amazed by the grace and leniency shown by members of this forum. It frequently leads me to wonder if I'm wrong for being such a hard-case and profiling people out in the wild on the basis of behavior patterns. So far the process has worked reasonably well for me and keeps me from being perpetually disappointed when people revert back to their own internal common denominators. It's also kept me alive on one occasion, but I digress.

No. Nothing wrong with being a hardcase. Too many soft skinned folks these days that want to be PC and make everyone like them online by saying the coolest, wittiest thing of the day.

I call it like I see it.

So far it's on record that he went out of his way to produce a racist, hate filled email to a politician. He make a comment, won't ask you what, about your deceased daughter. He wants to play the "I'm not going to discuss it" game.

Like I said before..I'm not perfect. I've rubbed PLENTY of people the wrong because I speak my mind and stand by my values...regardless of how unpopular my views might seem to some. But this guy? Absolute lowlife that I won't show one bit of pity or leniency towards. No reason to. He makes excuses...not apoligies. I agree with what another member said...If you're a racist douche...atleast stand by that and own it. I can respect someone that stands by who they are ...not act one way in life..then deny it or duck it when confronted and called on it.

Had some classless douche make some negative remark about my deceased child....yes, I would have lowered myself to that level and taken the issue from online to reality...and I would pay whatever price for my actions. I applaid you for showing enormous amounts of self restraint when having confronted him face to face. Had that been me? It would have been a bad day for everyone involved.

I don't presume to speak for anyone else on this site, especially after David has been so gracious to allow you to stay, but for me, you are done. There is nothing you can say to bring yourself back from whatever place it is that you are. At least own your actions. I would have a bit of respect for that. Hiding behind laws? You cared naught for them when they didn't suit your purpose.

My only hope is that one day you gain the ability to realize what a little person you really are and somehow manage to make amends for the wrongs that you have committed.

Murgatroy, before you just to conclusions and get angry can you wait until I can get in contact with my attorney? I assure you I am not hiding behind any laws because they suit my purposes, far from it in fact. You and everyone else will get what you are asking for but I am asking you to be patient until I can get in contact with him. It has nothing to do with me not being unrepentant, or what anyone else says. None of you understand right now, but when I am able to discuss what it is that happened, you will better understand. If I don't hear back from him tomorrow I will put a phone call in.

I'm going to close this thread down for about 24 hours so that everyone has a chance to take a breath and let emotions settle. I'm not giving anyone a free pass here but I'm also not wanting the thread to turn into a complete pile-up where folks let their feelings get the best of them.

Rational discuss is always welcomed so we can aim for some more of that once the thread re-opens.
