I dont know the real answer to this, BUT my father gave my 12 year old son an original Ruger Standard .22 pistol, a Remington Fieldmaster Pump .22 rifle, and a custom .30 cal M1 Carbine.

They are my sons guns, not mine.

And anyway, didnt everyone on this board have a gun growing up ???

My husband is currently in Iraq, and I will be living near the base but not *at* the base, I am 18 and have heard where I am going to live (move up there August 19th from TX) is well.. not around the best of people (not trying to be racist)

Am I legaly able to buy my own gun? I know that its legal for my stepbrother from West Virgina to bring me a gun and give it to me, but can I legaly buy my own?

In TN you can not buy a hand gun through an FFL dealer,but you can buy a long gun all day long.

The legal age to buy a handgun is 21. For a long gun its 18.

Yes you can own one. Someone correct me if I’m wrong… I don’t think you can buy from an FFL because they have to go by Federal law, but I think state law allows purchase of a handgun at 18 from a private owner.

I'm not sure that is legal. (Although if I were your step-brother I would do it.)

Are you switching your driver license from a TX to TN when you move here? If you are not a legal resident of TN, you generally cannot buy a handgun from a dealer or private seller in TN. If you intend on keeping TX residency and are 18, buy your handgun out of the newspaper in Texas. You can drive, thankfully, from Texas, through Arkansas to the AR-TN line with a loaded handgun in your car at 18 without any sort of license, if that helps you out any. You can also have a loaded rifle/shotgun in your car when driving across Texas and Arkansas. Be sure your handgun is concealed in Texas and it would be a good idea to have it concealed in your car in Arkansas.

Ummm...what about the question on the fomr when buying a gun from an FFL that says, "Are you the actual purchaser of this firearm, and are not buying this firearm for someone else?" That seems worded not to exclude gifts...

someone please tell me i'm wrong there. I don't wanna keep assuming I would have to take whoever I wanted to give the gun to with me to the shop, and have them do everything but me pay.

I guess you could look at it preventing gifting, but I take it more that it is trying to prevent you from buying one for someone that it would otherwise be unlawful for them to purchase. ....of course I guess that could be underage as well.

I am 19 also and i know i can have a handgun in my home loaded and all. but what about my car? is there anyway i can carry one with me in the car everywere i go and it be legal?? also If you get caught carrying a handgun with out a permit what is the charge? do the police take your gun? or are they even allowed to?

Unlawful carrying or possession of a weapon, commonly called "intent to go armed"

First offense is Class C misdemeanor, code says $500 fine, which I don't understand, as I thought Class C was $50 max (and/or 30 days).

If in public place with at least one other person around, jumps to class A misdemeanor. Really raises the ante to 11/29 and/or $2500 fine.

If they arrest you, certainly. Getting it back, I dunno, depends. Happened to me in a previous incarnation, case thrown out on first hearing, but I never got the gun back. And it wasn't even loaded; but ammo was in same bag.

If they don't arrest you, but just cite you, I'm guessing they can, but again, not sure.

One of this forum's mods is an attorney, perhaps he'll give you more definitive answers.

If you're going to do glove box/trunk, keep your lead locked up. Get a little case or something. And don't call it a clip.

Here in Memphis, I believe the way the prosecutors still do it (haven't had an unlawful possession case in a while) is if you plead guilty, part of the deal is they keep the gun. If the case is dismissed you might be able to get it back, but again part of the deal might be that they keep it. It depends on the jurisdiction. If you don't get it back and feel you should, you could always file some kind of petition to return property.

Whether or not you are charged with a weapons violation really depends on how the cops found the gun, what they were looking for when they found it, your attitude, and their discretion.

So yea dude had a court date for intent to go armed and was trying to buy a gun. Don't mess your life up kid. Get a case with a lock and put it in the trunk if you're going somewhere to shoot.

Could, but as Mr. P. Stegall, Esq. advises, better to have some part of the gun/ammo equation locked up. Gun in locked case in trunk with ammunition in different part of vehicle is safest.

It's only a misdemeanor, even if you've been caught doing it more than once. Doesn't even disqualify you from obtaining HCP, let alone merely owning firearms?

Actually, seems that is NOT correct to me. That pending charge doesn't have the possibility of a year's sentence, so are you sure that's why it was denied?
