What is legal protocal if I am on a road trip or out driving around town and find myself on property that does not allow conceal carry such as a park or university church? Can I still leagally leave my gun in my locked truck while parked say in a park parking lot pproperty that does not allow guns? I go to a church that is on a university campus. Can I leave my gun in the locked truck and still be legal?

Thanks,

Yes. In theory you must put lock it up before you enter the property and cannot retrieve it until after you exit the property.

There's a specific exemption for school property that allows you to possess it, as long as you don't "handle" it and are dropping off or picking up a passenger.

You are also permitted to transport a firearm across park property with the firearm and ammo separate.

A non-student adult may store a firearm in car on school property, but the way statute is written, it is generally assumed that means unloaded, since it makes no distinction for HCP holders in that instance, and unlike the first paragraph in same statute does not mention "intent to go armed".

And yes, on school property, with an HCP you may have loaded gun in car or on you only if picking up dropping off passengers. If you leave vehicle, see above.

does non-student mean that the person does not go to that school? or does it mean any one who does not attend any college in the state?

This happened to me the week I photographed the UT game. I have a friend out there I was staying with. Stopped at his house to pick him up, and I put my luggage and my gun inside of his apartment, then we headed down to UT's campus to pickup our press passes for the game. I wasn't sure how the non-student designation works, but since I go to MTSU and I was visiting UT's campus to briefly pickup a press pass, I didn't want to chance it since I wasn't exactly sure, and left the gun at my friend's apt.

The answer is, like many other instances in TN weapons law, clearly gray. :)

What if you're a student in Alabama, even.

and to add, if I inadvertantly found myself on a school property wearing my piece I would drive off of it asap. If I discovered I must be there to accomplish my task I would seperate the gun from ammo and store the gun and ammo as if I had no permit.

I would think it reasonable to assume by student they mean student of that school...

Yeah, you'd think, what's the logic of banning an adult student of that particular institution from carrying rather than an adult student of any institution?

What's the logic of banning an adult student period?

Given they do want to ban some or all adult students, how much IQ would it take to clarify that sentence as to intent? Clearly more than the collective IQ of the TN legislature.

I think one of the biggest problems with 1309 is that it doesn't distinguish between elementary/high schools and college/universities.

Also since it includes all firearms (and other weapons), not just handguns, I have always taken the reason the didn't allow adult students to posses or have firearms in their vehicles was to keep 18 year old students in high school from being able to have a rifle/shotgun in their vehicle.

But there is LOTS of room for improvement and clarification.....
