Car Console Carry Question

I have a carry permit. I know if I'm driving by myself there is no problem with me carrying my loaded firearm in a dash or center console... My question is, does that change if I have a passenger in the car? - Say, my wife or minor child riding in the front seat (both well trained around firearms, but do not have carry permits) either would have equal access to the firearm as myself. Would that change things? - It wouldn't be under my control, but equal control.

Would it be different if the situation was reversed and I was the passenger and my non-permitted wife, or a friend was driving?

Just wunderin'...

I don't think there's a problem unless they have the gun in their hands. Somebody will be along with a better answer. Leaving them in the car by themselves with the gun in the console is probably a different story.

Just don't run in the store and leave it in the car with them....:rolleyes:

Have your wife get a permit. That's what I did so if she drives my car without me I don't have to remember to get my gun.

Anyone within arms reach of it has constructive possesion...and if they didn't have a HCP if one wanted to make a case of it, they could...or at least get it started. That said...

As long as you are in the car too, there shouldn't be a problem.

And here's the good news... If the gun is in the console, SHE has to go in and get the beer. If you go, she runs the risk of going to prison. :rolleyes:

I'm going to try that one real soon.

If a cop was in a very bad mood he could try & make something of it but I dont really see that happening. You never know tho....

if you are in the car there will be no problem.

If someone who has no permit is alone with the gun there is potential for lots of problems. This from first hand experience.

If you have to get out of the car my advice is to take the gun with you.

Oh, I thought he was talking about asking the wife to run in and get some beer so she didn’t have to go to prison.
