Hmm, read somewhere that they would eventually make it impossible to trade without certain "marks". But that couldn't have been correct. It was an old old book.

That's a dumb law and I imagine it will be almost impossible to enforce. Yeh, some judge will kill it.

Yes, I've been watching this and it should cause everyone concern. The revenuers are clamping down to ensure that our "civil servants" are able to collect pay checks. With the economic issues finally causing governments to really feel the pinch in tax revenue, they will pursue any means possible to keep eating at our expense.

Every time I've heard mention of a flat tax, my thought has been that laws like this would become commonplace in order to make sure everyone didn't move to the second hand / black market. I had not really considered that it would start from the state level, unless it was solely directed at precious metals, which are mentioned in the text of the bill.

The bill classifies anyone who performs more than one secondhand transaction per month as a second hand dealer. Surely, the next step will be to require licensing and perhaps even impose fines for not acquiring "permission" (a license) to do so.

Unenforceable. Sounds like the lawyers consulted when writing this law weren't at the top of their class.

Would someone please show me where in the bill it says that cash is banned?

If I am not mistaken we already have a law in TN that is very similar to this one.

You are correct and there is somewhat of a misconception. The bill is doing away with cash and carry, anonymous transactions of a wide variety of second hand items. It also classifies anyone who performs more than one transaction a month as a dealer.

It does place an unnecessarily heavy burden on anyone accepting cash in a transaction as well. In my non-lawyerly opinion this amounts to prior restraint, lack of due process, and probably a couple of others. If this isn't struck down by the courts then God save us all.

As I mentioned before Tennessee has a similar law.

TOTALLY different situation. That law applies to the scrap sale of copper only. If you sell steel, stainless steel, aluminum, junk a car, etc., you show your ID (as has always been the standard) and walk home with cash on the spot. Copper scrap sales require either a check by mail (next day) or a 5 day waiting period, after which you can go redeem your voucher for cash. That law was put in place to combat the epidemic level theft of copper.

That law does not apply to normal, every day people. I deal with scrap metal at my job and my experiences are as stated.
