Went downtown today in Chattanooga and I noticed that the Mellow Mushroom has finally taken their gunbuster sign down! Just a heads up for you guys, hopefully it's a permanent removal and not a transition to a replacement. (their previous sign was rather worn and faded) But as of right now, no sign!

The Mellow Mushroom in Sevierville/Pigeon Forge area has a sign. I have spoken with the manager and they said the owner put it up. I was going to call the owner but thought it was a waste of time.

To my knowledge, the MM in Franklin is NOT posted, and never has been. And while I haven't been lately, I have been several times and have never seen anything posted.

Yup, I go there as often as my wallet affords. They aren't posted. I'm addicted to their esperanza sauce!

Forgive my ignorance; I'm new to TN carry laws. But I thought you couldn't carry anywhere that alcohol is served, and mellow mushroom serves booze.

It was that way until about a year ago. Now it's perfectly legal as long as the business isn't properly posted. You can't consume while carrying though.

Really? I was going off of this, from 2009:

Looked to me like the bill had been passed, but vetoed. TN 17-39-1305, yeah? LexisNexis shows it as "repealed" but the info on the tn.gov site seems to point to bill having been vetoed, with no mention of an override...

That location had a sign up about 2 weeks ago, but it just read "No Firearms" or something like that. I don't even think it's on the door, just off to the side.

I went about a month ago. It must of been very small & way off to the side. Because my wife and myself didnt see a sign.

(you reversed some numbers) 39-17-1305 was suspended by court order, then repealed and addressed with the revised 17-39-1321 during the next year. Posting is covered in the revised 39-17-1351 (if that answers your question).

Ok, so I read that to be as Erik88 says: Legal to carry in a restaurant (or bar?) as long as it's not lawfully posted, but I just can't consume alcohol. Sound right?

Yeppers, as long as it's not posted, it's legal. Bars included. BUT... I wouldn't play around with the "no drinking" part, not even one... you'd better be sipping on soft drinks and/or water the whole night. If something ever did happen and you decided to partake before hand, you'll have to convince a jury that you were of sound mind while "intoxicated."

Like my HCP instructor told us.... just like you would designate a driver, you should designate a carrier also. (paraphrasing)

It's a crime to have a sip of a drink while carrying in an establishment open to the public, period.

It's not a crime to drink alcohol before or during carrying otherwise, as long as you don't become "intoxicated" (which is a separate crime, and is the call of LEO/Judge, BAC proof not needed for presumption of guilt).

But of course your admonition is certainly a sound one.

It's hard to see. We ate there twice in a weekend (hoagie addiction :rock:), and I didn't see it the first time.

Yeah, I'm not debating if it's legal or not, I'm just saying it's probably in your best interest to not drink alcohol at all while carrying.
