Surprized this has not been brought up before considering the Ashland City road rage incident went to 11 pages.

And similarly the person who was shot brought the gun out.

The victim should have called the police or left. In fact almost anything but what he did would have been better.

The shooter,charged with 2nd degree murder was released on $25,000 bond. I guess bond is an indication of flight risk as opposed to guilt,still that seems like a low figure.

Johnson will most likely be found guilty. once he had possession of the handgun, there was no threat to him. He made a conscious decision to execute an unarmed man at that point. it doesn't work that way. once the aggressor is unarmed, you're no longer in imminent fear of death or serious injury.

stupid is as stupid does. best bet when he got the upper hand and got the weapon from the guy, would have been to detain the guy by making a citizens arrest, calling the police and letting them handle it, and then Alley would be on trial for aggravated assault, possession of a firearm while under the influence/intoxicated.

instead anger and vengeance clouded his judgement, and he executed an unarmed man, who was no longer placing him in fear of imminent death or serious bodily injury. hope he enjoys the inside of his cage, he'll have a lot of time to think about this one.
