Sounds like there's enough uncertainty in this to call into question whether it was really an accident. It'll be interesting to see how this turns out.

"At some point when the gun was pointed at her head, it "went off," Marshall told police."

He should be put in jail for that alone, what kind of an idiot points a loaded gun at his wife's head? And why on earth was he "in the bedroom loading several guns" to begin with? Why bother loading them if he had no intention of using them?

Mine are loaded all the time and I never have any intention of using them unless I'm going to the range. :screwy:

I'd say he's right. It always seems to be the owners that you have to watch out for.

Well, I dunno... I'm still new to the gun owning thing. I can see keeping one or two loaded for self defense but do you really keep them all loaded all the time? The article makes it sound as if he were loading several guns... regardless though, I don't think you or anyone here would point a loaded gun at their wife's head.

Then there's this bit from the article...

"Marshall told detectives he had a felony conviction and could not own firearms that fired cartridges, so he kept a large collection of replica black powder rifles and revolvers."

Was the felony for shooting his previous wife in the head?

An unloaded gun is just a club. I keep all of mine loaded, even my .22's, because you never know which one you'll be able to get to in an emergency. And no, you never should point a gun at anything you don't intend to destroy. Sad story.

That is correct, you can have BP relics without any permits or anything else, they are considered to be too much trouble for the serious criminal. As for keeping them loaded, I used to do that as well, but then decided that if we had a fire nothing would survive it. So the ones in my safe are unloaded now and no ammo stored in the safe (a few magazines loaded and nearby it though), while the ones around the house are all loaded and ready to go. I think we have 6 loaded ones around the house. Not that I need 6 at once, its to have 1 in every strategic area, rather than try to reach a distant one in a situation.

Yep. Every single firearm I own with one or two exceptions are kept loaded. An unloaded firearm is just a paperweight. We unfortunately don't have the ability to choose the time and place of an attack or home invasion, and certainly don't have the ability to foresee every possible scenario and outcome. Therefor it is my belief that I should have every tool available to protect my life if needed.
