The states aren't really challenging. If they were then you would have state troopers keeping the ATF out of the places only making guns for sale in their state.

And since it's the 9th Fed appeals, yep it's

going to make it to SCOTUS. Holder wants

to nullify. He's an American, isn't he?

If it's going to SCOTUS, it needs to happen before Obama appoints any more judges. Hopefully, the NRA will jump into the fight as well.

That's the reason Justice Kennedy gave when

he decided to postpone his retirement plans,

from what I heard. He is a patriot for doing that.

Here's the ridiculous part:

A district court judge agreed to dismiss the case, essentially saying nobody could challenge federal gun laws without expending the significant capital needed to start the new manufacturing enterprise, making a gun and being tossed in the slammer.

Courts rule wrongly. That's why there's an appeals process. If you think something is unconstitutional, but the penalty is death, you shouldn't have to break the law and risk death just to have standing.
