Illinois is moving towards having carry permits; if we can keep it from getting bogged down in 2nd amendment debates.

However… while this is a step in the right direction I don’t see where anything has changed.

This case was tossed because the Cook County State’s Attorney brought the wrong changes. I skimmed over the court’s ruling. FOID cards are not required by out of state residents. You can’t get one, and you can’t be charged under those laws. The court did not allow the jury to be instructed on the proper lesser misdemeanor offense of unlawful use of a firearm (Carrying a loaded gun).

I’m not sure, but I don’t see anything that stops the trial court from filing on the proper change and having a new trial. Maybe one of our lawyers could comment on if that would be double jeopardy.

I travel to Illinois all the time and carry a lot of guns in my vehicles. I know I won’t be carrying a loaded gun based on this court ruling.

I’ll ask my daughter to find out how the States Attorney’s and the Police departments interpret this.
