... So anything saved offsite from your yahoo, google, hotmail or whatever offsite mail provider would not be constitutionally protected.

No it's the opposite. Email older than 180 days onsite on yahoo, google, etc (the cloud) is currently fair game. Obama admin wants to keep it that way.

Downloaded offsite to your own server or personal computer still requires probable cause and warrant.

I was coming to post this. But yes OhShoot is right. If you leave your mail on their server for more than 6 months they do not need a warrant to get it. Be careful when using outlook aswell. I dont remember which but between imap and pop3 one leaves your mail on the remote server and just makes a copy in outlook. The other removes it from the remote server.

But the Obama administration testified that imposing constitutional safeguards on e-mail stored in the cloud would be an unnecessary burden on the government. Probable-cause warrants would only get in the government’s way.

That statement should shed a lot of light on how the government views themselves. They feel that protection your Constitutional rights is an unnecessary burden. Which is the way it was intended. But they now want the burden of protecting your rights to be on you, not them. Damn I hate these people.

This comment is amusing.

Democrats and Republicans agree on many, many things, but the one thing they really agree on is that this obnoxious and annoying document from a bygone era, the so-called Constitution and its cloying Bill of Rights, is a tool of terrorists, extremists, and wild-eyed subversives who keep carping on it like it has any relevance to today's events.

Really, people. Can't we just get over this whole due process, civil rights, representative democracy THING and let plutocracy get on with the very important task of sculpting a better world for the 1% who matter?

Sick and ****ing tired of all of you commoners bitching about healthcare, jobs, your precious clean air and water when we desperately need to secure the supply of conflict diamonds in Africa in advance of Paris Hilton's 2012 Oscar party.

I would be willing to compromise just to help them out. I really would!

I will send them all of my Viagra and African millionaire emails without delay!

In some cases, this link can be hard to establish. In one recent case, for example, law enforcement officers knew that a child exploitation subject had used one account to send and receive child pornography, and officers discovered that he had another email account, but they lacked evidence about his use of the second account.

:hat::usa:

If I have PC to get a warrant on a child pornographer I will ask that it be for all email accounts and anywhere that the suspect may store email, photos, and any other electronic or printed materials….And I would get it.

That's because it's not that hard to see when your head isn't stuck in your fourth point of contact.
