how long for points to come off driving record?

I am going to try to leave all emotions behind on this post.

My wife and I disagree with the ticket she got this morning.

This morning my wife got a ticket going to work. Pulling out from a stop sign, she got a failure to yield ticket. We disagree with it, however her word against his. He had to get turned around and come up though traffic to get her pulled over on a narrow road.

It seems the ticket will be 90 dollars if she just pays it. It is 4 points on the driving record.

1. We are not sure if the insurance would automatically find out about that and change any rates or not.

2. If we decide to try to dispute the ticket, thanks to our legal system instead of justice system, we have to pay court costs even if we win. However assume we lose and are offered traffic school, we pay court cost, ticket, plus traffic school it will be expense but keeps the points off the records per the city website.

Takes 3 years for the insurance. I have paid and disputed and if you think you were in the right I would fight it if you have the time and able to miss work it was worth it to me. Insurance usually doesnt find out till you renew.

I was wondering if the insurance really checked. I know a few years back she got a ticket and there was no dispute and we did not notice a rate change. It was a minor accident that the insurance for sure knew about. She got the ticket.

Would 4 points have an effect on insurance?

We are actually paying our insurance this month, already have the bill in hand so our next bill will not be until Aug..

I am wondering if I should talk to my insurance guy. He has been a pretty straight with me over the years and just ask him if 4 points would hurt.

I guess I am trying to figure out what is going to hurt the least.

Her to lose a a day of work, plus court/ticket, and traffic school or possible rate increase for as pointed out maybe 3 years.

add court cost takes the 90 dollar ticket to 130 some dollars (assuming the judge disagrees) , and traffic school which is about 122.50.

So it would be about 250 to avoid points if the judge would give traffic school.

Plus have to consider the lost day of work to be at court. So about 350 verse 90. So really $350(with lose days work) to keep the 4 points off the record or pay 90 and risk it hitting the insurance some.

As an employee of an auto insurance carrier, we do check in certain instances. BIG HINT. DON"T ADMIT TO ANYTHING! Also, Another trick, change insurance companies if they catch it. The person without the ticket purchase the policy. After you purchase the policy, add the other driver . . . just say'n. Also, Tennessee offers a safe driving class that'll keep the points off of your record.

Go to the class, pay the extra fees. Insurance will find out and the difference in rate will be a lot more than the fees/ court costs.

EDIT: My last ticket was in Nashville about a year ago. I was able to admit guilt(?), pay the fees AND take the class online. I was finished the next day. The ticket was about $100. Total costs were only about $150. Don't remember now if it was a TN or Metro website, but worth checking into - it was WAY cheaper than going to court. Took about 1-1/2 hours to do the "class" online instead of taking up a whole Saturday.

Your point system is on a 12 month system. Any points on record are not counted after 12 months of infraction. You are only allowed 12 before suspension if I'm not mistaken. Also here is the official point values from the state. Schedule of Points Values

I ogt a ticket for doing 45 in a 30 years ago (around 2000 to 2004, not sure). I paid the ticket, my insurance never went up.

I also got into an accident in 2008 (long story short, her fault but cop said my fault. I went to merge in to a new lane (new as in it was new to the part of the road I was on) hauling a 16 ft trailer so Iwait until I can clear the curb before making my change, well the dipstick shoots around the rear of the trailer and I ran her off the road, I had my signal on and did check to see if the road was clear before starting my move.) I got points on my DL for that but my insurance never went up and I still got my "safe drivers discount". My insruance co paid for her car to be fixed, don't know if anyone paid for applebees mailbox to be replaced but she knocked it over, I paid for my damages out of my pocket (cost me 300 to have the dent removed from my fender).

So that being said, it looks like the point system is a crap shoot. Don't call your insurance company, if they find out and raise your rates then act, but until then let it ride.

Insurance Companies can find out about it if they order a MVR from Choicepoint(LexusNexus) at renewal or endorsement time. If they do this and receive a hit back on your driving record, it is their choice to increase your premium.

I got 11 in one day (wasn't a great day) and I can tell you it is one year before they fall off.

THP........thats what happens when they clock you at 153 in a 65..............that was 14 years ago...havn't had one since..I guess I learned something

Like I said, I checked my emotes at the door on this one. I could say allot more here and if I said a few more things I know are going on. However I would be on vacation and frankly I like it around here.

Like Dralarms said, I have had a case where my insurance paid for damage on another car in OH and I got a ticket for that in OH. The cars did not touch but I got the failure to yield ticket then. My rate did not go up.

A few years ago my wife had a minor accident in Knoxville and our insurance paid for damage on the other car and we submit no claim on her car. She got the ticket on that. Our rate did not go up and we kept safe driver discount.

I am starting to think just a couple points won't hurt, If they drop off in one year.

Going back to what Terry_Frymire said, the policy is in my name and my wife is a driver on it. We just had the yearly renew this month, like I said I have the bill in hand for the next 6 months. Yea I am going to pay it up for 6. My wife is a driver on it. We both currently have safe driver discount. As of today I have 0 points.

Here is a good question, why are some traffic schools as much as 122.50 they send you too, instead of letting you take the 50 dollar ones on line that some people get to take to avoild the points. In short, why do some people have to pay more while others have the option to pay less?

I didn't even realize TN had a point system. I have been lucky when it comes to tickets. My first was was driving 60 mph in a 35 mph zone. I had to go to before Judge Williams on that one. He was very nice to me and threw out the ticket. He only charged me court cost and made me take a defensive driving course. My last ticket was around 5 years ago. I was doing 97 in a 70 in GA. The officer was nice and dropped it to 88. I still had to pay $150 for the ticket. Now, I have really slowed down to the point I could drive Miss Daisy.

For the record, my agent (a long-time friend) informed my wife to simply pay her ticket - to date they've not run her license in over seven years. That was over a year ago and still no increases.

I am starting to think in that direction. They probably won't run it unless they have a reason to, as those reports are not free. They may run a random number of them but I am sure they don't run them yearly for everyone. I am sure they can get a discount but I found if I want to pull a report on myself it costs 40 bucks. Since I know I haven't recently been stopped, there is no reason for me to.

We might just pay it and forget it.

BTW,

I found the City site on the Red Light cameras while I was at it, they have updated it since I last looked

Here is something I found interesting.

Q: What if I do not believe I was speeding and/or ran a red light?

A: Your notice contains a hearing request form (Option C) to fill out if you would like a hearing scheduled before City Court. If you would like a hearing, please return this form by the time indicated on your notice. If you are found liable by the judge, you will be assessed court costs in the amount of $72.75, which will be in addition to the $50 amount due for the violation.

However, it does not talk about what the court fees are if you are found not liable. I have always hear if you go infront of a judge you have to pay court cost which to me indicates a broken system. Can't win for losing.

O, I ask my wife the big question, did he ask if she had any firearms or weapons. Nope. That never came up. I know I have never not been ask if there was a firearm in or around me or the vehicle.
