Wow, this basically re-writes the law... cleans it up some... but it's going to take a lot of time to dig through and figure out what has changed... I do see the $10 TICS fee can now go down, but no controls are placed on TDOS preventing them from hiring or buying equipment to make sure it never goes down.

No companion bill listed as of earlier this afternoon...but, there's still time.

Looks to be some interesting things within...he's worked parking lot exemptions into various nooks and crannies. Keeps use of circle/slash for proper notice of posting. I didn't''see any exemption of background check for HCP holders, but it could easily be there and I just missed it in a quick scan.

I'm not positive, but it seems in this bills version of 1359 governments would only be allowed to post buildings, not parking structures or grounds. Also it does seem to remove the prior 1986 laws still on the book. Now, I don't see where it would still allow local governments to post public parks... do any of you?

HB 1668 would:

  • Allow gun owners to lawfully store firearms in their privately-owned and locked vehicle while parked in publicly accessible parking lots controlled by their employer or a business that they frequent. The bill would not affect a situation in which firearms were banned from the premises, as a matter of state or federal law, or in which the vehicle had no authority to be on the property in the first place.
  • Strengthen current firearm preemption laws by prohibiting local government entities from banning firearms outside “buildings” under their control or in private vehicles. It would also fix the local parks provision and eliminate the patchwork of laws across the state by invalidating existing ordinances, rules, or other provisions that would conflict with the state firearm preemption law.
  • Create provisions that would prevent the Tennessee Bureau of Investigation (TBI) from using the fees charged for background checks as a general revenue source and limit the fees to no more than what it costs to run the background check system.
  • Require TBI to destroy records pertaining to an approved firearm transfer by the end of the business day on which the background check occurred and prohibit the duplication, transfer, or reproduction of such records while moving up the date of issuing permits from 90 days to 45 days.
  • Prohibit public or private landlords from enacting lease clauses that ban firearms from a lessee’s residential or business premises.
  • Repeal the general bans on the carrying of handguns by those with permits in refuges, public hunting areas, or wildlife management areas that are located within the boundaries of a state park or state natural area.
  • Codify the Fraudulent Firearms Prevention Act and stop private sting operations by cronies of anti-gun New York City Mayor Michael Bloomberg.
  • Repeal over-reaching disqualifiers for a carry permit including to those who have had their rights restored, bringing Tennessee in line with current federal standards.
  • Clarify a posting provision for school buildings and grounds from where firearms are banned.

I hope I ending up eating crow on this one, but I don't think it will pass with all those provisions in there. The one that really caught my attention is the one overriding local park bans. Many of the Congressmen will have locales within their district that have enacted bans and I just don't see the political advantage in telling them all to go jump in a lake. Like I said, I hope I'm wrong, but...

I can only hope that since this compilation of changes was put forward by the Speaker Pro Tempore of the House, that it was not a rash endeavor, but a well thought out, calculated decision on the part of the Leadership to address several important issues.

The makeup of the House is different than in past years, alliances that were in force no longer exist, and it could be that with so many new members, it reduces the institutionalized pressures from old power brokers, or so one would hope.

We will see.

Also keep in mind, for the first time in my life time we have a true republican controlled legislature in TN, with a republican governor. It's very unlikely that the Democrats could prevent this legislation from moving forward.

Tennessee Republicans don't need an opposition in order to fail.

That includes most that we send to Washington.

When we see the date for this bill to be presented to the House Judiciary Committee we need everyone to email every member of the committee and tell them we want to see the bill approved and passed on to the house floor for a vote by the entire House of Representatives and then on to the Senate, and hopefully the Governor. This is what my house representative told me needs to happen to try to get this bill to the floor for a vote.
