Can I sell a gun used in a suicide?

Ok I am looking for some info on selling a handgun that a friend used to take her own life. Its a long story so I will give you a short version. I had a friend intrested in a gun I had for sale. She wanted it asked me to show here everything about it and asked if she could pay me the next day. Well that night she took her life and the police took the gun. After a year the PD contacted me and told me I could have my gun back. My wife is not having it and wants it out of the house ASAP.

I asked a local shop about trading it or what my options were and they told me that it could not be sold. He said that since it was linked to a crime that it would not clear once they tried to sell it, and that all the antigun groups could come down on their shop and have their license pulled. He said that they were not intrested in doing any business with me because I tried to "screw" them with trading the gun.

Another local store told me that there should be no problems with selling or trading it. The guy there told me that it as long as the police gave it back it should show up with clear record when it is transfered to a new owner.

Anyone have any info about this? I don't want to ship to someone and them not be able to get it if it will not clear in the back ground check, or sell it face to face and have problems if they trade it somewhere.

Yeah I would think that since the police gave it back it would be good but I just wanna be sure before I do anything. I have talked to 4 dealers so far and no one has gave me the same answer yet.

here is a dumb question pertaining to this thread. Is a successful suicide actually illegal? I mean assuming you are successful there is not anyway to prosecute you.

And the cops gave you the gun back.

If you are really set on selling it post it for sale, or take it to a gun show.

If it was me and I had to sell it I would not offer any explanation for the sale. Guns do not inherently cause suicide, it is not possessed by a demon.

and I am not sure how you tried to screw the one gunshop, you told them upfront what was up with the weapon.

Maybe someone here who is a FFL will reply.

Man, very sorry to hear about your friend.

I really don't have an answer to your question. As Mike said, maybe a FFL will chime in. I am curious though. Did your friend's family have any ill feelings toward you after this?

Couple things,

I believe it could be sold, this is just my opinion.

I don't like the go throw it in the river idea.

Some people attach a stigma to guns when they have been connected to a death/murder or suicide. To me that is no more then a believing in ghosts.

I really can't see a legal reason why you could not be allowed to sell it since it was returned to you. I am not a lawyer, nor do I play one on TV.

Sounds like that shop went overboard or at least over reacted because you ask a question. That shop may be a bit paranoid.

A little information about police reports. Even if that weapon was used in a suicide the serial number would have no entry into a computer database like NCIC or whatever you want to call them. It probably was listed in the report as a identifying number on that piece of evidence but that stuff on a report is not entered like that in a computer. It would be listed if you reported a weapon with that serial number as stolen. I wouldn't even mention the suicide part to someone wanting to buy it.

Thanks for the info so far guys. The first shop was very rude about the whole thing and will not be seeing me again. I don't know how I tried to screw them over by telling them up front the story behind it.

You didn't. Either the one guy at that shop has a serious problem, or the whole shop does (passed down from owner? who knows?), but if you are up front about something and they say NO, and you do not push the issue, whats the problem? The problem is 100% in the mind of the shop guy you talked to. If that was the owner/manager or someone important, there is a problem with the shop. If it was just some clerk, he could have acted on his own without the owner or "store's" knowledge. So it matters who you spoke with. If it was the owner, never return there and tell anyone who asks that the shop is no good. If it was a clerk, contact the owner and tell him about it, so he can fire the clerk. It helps everyone out if you can get a bad clerk fired, or post a "dont shop there" if they refuse to apologise. You never know, if it turns out to be the clerk it could become your favorite shop if the owner/manager is cool about it...

As far as I am aware, suicide is not a crime. As long as the police returned the firearme, you should be good to go. It would be illegal for them to return an illegal firearm to you.

Actually it is if you arent successful. Isnt it kind of like attempted murder but not really?

Didint know there were any gun shops in Crossville. I am aware of tabors pawn which is fairly reputable at least from my business dealings and then another pawn shop I cant remember the name of.

Dave's Pawn, and I dont see them being that way, but you never know. Outdoor Junction isn't too far. He didn't actually say it was in crossville

Well, I did hit my thumb with a hammer once. i am pretty sure the hammer was evil. It seems fine after I cursed the demons from it.

Like I said, they had a extra helping of paranoia.

Going back to my first statement about how people put a stigma on a gun in events like this, it might only be fair to the buyer to let them know the history of it.

Well, I did hit my thumb with a hammer once. i am pretty sure the hammer was evil. It seems fine after I cursed the demons from it.

I knew a person that when he hit his thumb he praised the Lord. When ask why, he said something about it was better then cussing and it was his own fault for hitting himself.
