Short barrel shotgun question

When creating a "sawn off" shotgun out of an old double barrel i know you have to go through similar channels when making the AOW as you do when making an SBR.

Now i know you CANNOT turn a rifle into pistol. IE hacking the stock off.

But from what i understand when i make the short shotgun i CAN hack off both the barrel AND the stock; Creating a pistol grip, pistol sized shotgun.

This is because im making an AOW not SBR.

And its an AOW since it is a smoothbore.

Are all of my assumptions and previous readings correct?

IIRC:

AOW - $200 to manufacture, $5 to transfer

SBS - $200 to manufacture, $200 to transfer

AOW - must have pistol grip, barrel <16"

SBS - can have either pistol grip or stock, any barrel length as long or longer than reported the manufactured length

Thanks for clearing that up.

Im wanting an AOW SxS if another cheap one pops up

I've been looking into this one, I think the way to go is to build your own SBS - the initial build cost is the same but you get greater flexibility in that you can go from an AOW (pistol grip, very short barrel) all the way to a full on hunting shotgun (wth stock and 28" barrel) with one firearm, any time you want. Sure, the tax stamp costs the buyer more if you ever transfer it, but you get much greater flexibility with the SBS.

If you're going to buy from someone else, then yah, AOW is probably cheaper.

Im wanting to make the AOW myself.

Now say i pay my tax stamp and cut the barrel to 12"

two years pass and i decide i would rather have a 6" barrel

Do i have to apply for another Tax stamp or can i just cut it down since i have already got the stamp once?

Hrmm, I *think* what you'd do it get the stamp for a 6" barrel and cut it to 12" for now.

I'm still researching this myself, so don't run with that just yet, hehe...

Im still learning now. Rather research for a yea before my purchase and not get my butt in trouble with the Feds.

An AOW is made from a shotgun that never had a buttstock installed. Pistol grip type only.

An SBS is made from shotguns that had a buttstock from the factory.

If you want one, you are much better off getting one already built. It saves the $200 fee. If you use a 870 or 500 model, than register it as is. IIRC, you can use a shorter barrel like you do a rifle, you just have to have the original barrel in order to put it in the original configuration.

so from what your saying a Double barrel would have to be an SBS since it came with a buttstock?

Yes if it came from the factory with a buttstock it will have to be a SBS. If you are "building" it yourself why not go with a SBS over the AOW, you are still going to have the $200 stamp.

Yah, that's my thinking - the only benefit to an AOW is the cheaper tax stamp upon transfer.

With factory built pistol gripped shotguns there is not barrel length requirement but there is the 26" OAL length requirement. If you can extend the pistol grip more rearward then you can shorten the barrel even more.

The reason for this is that pistol gripped shotguns do not fall under the rules for shotguns, rifles or pistols because it is considered none of them. They are there own seperate cetegory and as such are only regulated under the GCA and not the NFA even if the barrel is less than 18".

Here are the ATF letters "legalizing" pistol gripped shotguns with a barrel of less than 18".

No, all of your assumptions are not correct.

You can turn a rifle into an SBR, or a WMFAR (Weapon Made From A Rifle) on a Form 1 (Application to make and register a firearm.)

What you are talking about doing is not an AOW. It is a WMFAS (Weapon Made From A Shotgun) Just like the Remington 870 WMFAS that I made on a Form 1.

But it could also be registered as an SBS.

For more info, check out the ATF,s guide to NFA weapon classifications. ATF Online - Firearms - Guides - Identification of Firearms

I read over your link. Thank you for the Clarification.

I should be picking up my shotgun in a couple weeks.

But i know i have to wait until my 21st bday to fill out the paperwork and write the check. (And obviously wait for tax stamp return until firearm modification.)

You have to be 21 to buy an NFA weapon from a dealer but ATF will approve a Form 1 to make your own if you are at least 18.
