Took my class last week

Recommended Posts

I took my class last week, but since my passport expired & i cannot find my birth certificate it will be a little while longer before I get to DOS to apply for my permit.

That being said, I wanted to post that the Class at shooters Depot is worth taking, the time flew by and Officer Zirk Covered most everything very well. The range is sweet as well!

In the new video I caught that they told us we HAVE to present our HCP if we are stopped for anything, this was not my understanding of the law and forgot to ask about it later in class. Please correct me if I am wrong.

It is my understanding, and this is what my instructor told us, that you are obligated to inform the officer that you "have a valid permit, and that you are carrying at this time" if stopped for any reason. You should do this as soon as possible, but not in an aggressive or erratic manner. In other words, don't fly out of your car screaming "I'm armed, I'm armed!!!!"...

Typically, the officer will say a few words (i.e "do you know why I stopped you...") and then ask for your I.D. and insurance etc. At that point, once there is a break in his initial dialogue, you can offer that info in a calm manner.

I do not believe you have to offer your permit unless he then asks for it, which he might do. I have never heard that.

And of course if you're not carrying, then you are not obligated to tell him or show him anything.

Someone more informed can correct me, but I don't think Tennessee has any sort of law that requires a HCP holder to inform an officer he is carrying when stopped. I am not really saying whether I think it is a good idea or not, i just don't think it is required.

I will do a search of the relevant sections of the TCA later.

There is no requirement to inform an officer that you have a carry permit or whether you are armed or not.

That being said, it's a good idea to inform them since they will find out anyway when they run your dl.

I just took my class last weekend as well, and I asked about this. My instructor said that you do not have to let them know you have a license or are carrying unless they specifically ask you but they will know if you have a license to carry as soon as they run your DL. The video was trying to get you to let them know but you are not required.

There is NO law that requires you to inform an officer you are armed. All the law says is you must present your HCP upon the demand of an officer. (T.C.A. 39-17-1351(n)(1))

As others have said, check of your DL will show if you have a vaild HCP or not, but just because someone has a HCP doesn't mean they are armed.

Whether you choose to notify or not (many threads already on that subject) is up to you, but in TN it is not required.

Others have already said this: there is no requirement to volunteer the information. However, I didn't see this: you ARE required to present the permit if the officer asks for it. I don't have the reference in front of me, but I will post it later when I have time to look for it.

  • 3 weeks later...

Took me 1 day short of 3 weeks to get my permit once I submitted all of my paperwork and fingerprints. If you need a certified copy of your birth certificate, go to your county health department. I think it was $5 and took me about 10 minutes here in Blount County.

Sounds good! Hopefully three weeks or less. It took a little longer since I was born in Cali...
