Restructuring collection. FTF Show TN License and HCP as well as sign Bill of Sale
May I ask why someone would state "must show TN ID and HCP" for a handgun in the firearms classifieds? Just curious as I am fairly new to TN ............. I don't see the need for the HCP when purchasing a handgun from a non-FFL/non-Dealer as long as the resident is of legal age and states that they can legally own a handgun ......... I assume it is only a seller preference (as is a bill of sale) to show good intent towards firearms laws and protect the seller from a possible legality issue in the future.

Also, in Michigan I could ship a long gun from a legal MI resident to another legal MI resident (shipped within the State of MI) without an FFL being involved - assuming that both residents are of legal age and can own a firearm ......... does that apply in TN as well? I would normally have the buyer state that they can legally own a firearm and then they would send me a copy of his/her MI ID to ensure age, name and address were a match - which I kept for my own records.

To your first question, it's just seller preference. First, showing a TN ID shows that you are a resident of the state of TN, and showing a HCP shows that you are not likely a criminal. To your second question, yes, that is federal law. You can ship any firearm to another resident of your state, within the state.

Some people are worried they might get in trouble for selling to a felon. However, since we have no way to do a background check, violation of that law would require that you knew the person was a felon. But you are responsible to know that the buyer is of age and is a Tennessee resident. For that reason I require ID, if they don’t want to show it…pass.

Are far a shipping in state; yes it is legal if you can find a shipper to do it. I only tried it once on a shotgun. I didn’t want to send it through the post office so I took it to UPS. They wouldn’t ship it and I ended up driving to Chattanooga to deliver it in person. I won’t do that again.

Yes, as others have said, federal law applies.

But to echo Dave's statement, it can be tricky to do. In the case of a handgun, it's really pretty much impossible to do legally, since you can't send it USPS, and neither UPS or FedEx will ship it except to an FFL, regardless of federal law. You can ship it without disclosing the contents, but that's breaking federal law (shipments to non-license holders must be disclosed to shipper), and if you ship it anything but overnight, that's further breaking UPS/FedEX policies.
