I'm not going to comment with respect to the legalities of the OP's question since that's not an area of law I deal with. But, one thing I'd add, and I mean no disrespect to any TWRA officers, but there's one thing I've noticed when I've run into them while working. Most of them seem to use a little less "discretion" when dealing with situations. I've let many a minor infraction go with nothing more than a stern warning. I've never observed any slack from TWRA guys. Even as an LEO myself, I'd tread lightly when dealing with "gray" areas that they're responsible for enforcing.
